Casino Control Act
(Chapter 33A)
Casino Control (Problem Gambling — Exclusion Orders) (Amendment) Rules 2009
In exercise of the powers conferred by section 170 of the Casino Control Act, the National Council on Problem Gambling, with the approval of the Minister for Community Development, Youth and Sports, hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Casino Control (Problem Gambling — Exclusion Orders) (Amendment) Rules 2009 and shall come into operation on 20th November 2009.
Amendment of rule 2
2.  Rule 2(1) of the Casino Control (Problem Gambling — Exclusion Orders) Rules 2008 (G.N. No. S 623/2008) (referred to in these Rules as the principal Rules) is amended —
(a)by deleting the semi-colon at the end of the definition of “secretary” and substituting a full-stop; and
(b)by deleting the definitions of “self-exclusion order” and “third-party exclusion order”.
Deletion and substitution of rule 3
3.  Rule 3 of the principal Rules is deleted and the following rule substituted therefor:
Register of excluded persons
3.  The secretary shall keep and maintain a register, in electronic or other form, of —
(a)persons against whom a family exclusion order or an exclusion order has been made; and
(b)persons excluded under section 165A of the Act.”.
Amendment of rule 4
4.  Rule 4 of the principal Rules is amended —
(a)by deleting the words “or an exclusion order” in paragraph (a); and
(b)by inserting, immediately after paragraph (a), the following paragraphs:
(aa)records of every voluntary application under section 165A(1)(c) of the Act to be excluded from entering or remaining or taking part in any gaming on any casino premises (referred to in these Rules as an application for self-exclusion);
(ab)records of every notice to the Council under section 165A(3) of the Act by a person wishing to cease to be so excluded (referred to in these Rules as a notice to cease self-exclusion);
(ac)records of information leading to an exclusion order being made by a Committee;”.
Amendment of rule 15
5.  Rule 15(2) of the principal Rules is amended by deleting the words “any of” in sub-paragraph (b).
Deletion and substitution of Part IV
6.  Part IV of the principal Rules is deleted and the following Part substituted therefor:
PART IV
PROCEDURE FOR SELF-EXCLUSION
Application for self-exclusion
20.—(1)  An application for self-exclusion under section 165A(1)(c) of the Act may be made using the form set out on the Council’s Internet website http://www.ncpg.org.sg for this purpose.
(2)  For the purposes of section 165A(1)(c) of the Act, an application for self-exclusion may be made to the Council using the electronic system provided by the Council for this purpose, by completing and submitting the form referred to in paragraph (1) in accordance with the instructions specified in the form or in the electronic system.
Notice to cease self-exclusion
21.—(1)  A notice to cease self-exclusion under section 165A(3) of the Act may be made using such form that is provided by the Council and available at its office during such hours as the office is open for business or at such other locations as the Council may determine.
(2)  For the purposes of section 165A(3) of the Act, a notice to cease self-exclusion may be given to the Council in person at the office of the Council during such hours as the office is open for business or at such other locations as the Council may determine.”.
Amendment of rule 24
7.  Rule 24(5) of the principal Rules is amended by inserting, immediately after the words “the papers concerned”, the words “or by such other method as the Council may determine”.
Miscellaneous amendments
8.  The principal Rules are amended ––
(a)by deleting the words “a third-party exclusion order” in the following provisions and substituting in each case the words “an exclusion order”:
Rules 12, 13(1), 14(1), 15(1), 16(1), 17(1) and 19(1); and
(b)by deleting the word “third-party” in the following provisions:
Rules 12 (3rd line) and rule heading, 13 (rule heading), 14(1) and (3) and rule heading, 15(2)(a) and rule heading, 16(1) and (3) and rule heading, 17(2)(a) and (b) and rule heading and 19(2) and rule heading and Part III (Part heading).
