Control Order) (Amendment No. 11)
Regulations 2021
In exercise of the powers conferred by section 34(1) of the COVID‑19 (Temporary Measures) Act 2020, the Minister for Health makes the following Regulations:
Citation and commencement
1.  These Regulations are the COVID‑19 (Temporary Measures) (Performances and Other Activities — Control Order) (Amendment No. 11) Regulations 2021 and come into operation on 10 August 2021.
Amendment of regulation 2
2.  Regulation 2 of the COVID‑19 (Temporary Measures) (Performances and Other Activities — Control Order) Regulations 2020 (G.N. No. S 927/2020) (called in these Regulations the principal Regulations) is amended —
(a)by inserting, immediately before the definition of “approving authority” in paragraph (1), the following definition:
“ “approved test” has the meaning given by the Infectious Diseases (Mass Gathering Testing for Coronavirus Disease 2019) Regulations 2021 (G.N. No. S 273/2021);”; and
(b)by inserting, immediately after paragraph (5), the following paragraph:
(6)  For the purposes of these Regulations, an individual is treated as undergoing or having undergone an approved test in the same manner as under the Infectious Diseases (Mass Gathering Testing for Coronavirus Disease 2019) Regulations 2021.”.
New regulation 7A
3.  The principal Regulations are amended by inserting, immediately after regulation 7, the following regulation:
Live performance requiring cleared crew and performers
7A.—(1)  A person staging a live performance which is not a rehearsal must not stage a live performance that has playing a wind musical instrument or singing as an element of the performance (whether alone or in combination with any other performance elements) unless —
(a)every audience member —
(i)has a cleared status at all times during the period of the live performance; or
(ii)is an uncleared junior;
(b)every performer playing a wind musical instrument or singing (whether or not when wearing a mask) meets one of the following conditions:
(i)he or she has at all times during the period of the live performance, a cleared status (limited) that is current under the Infectious Diseases (Mass Gathering Testing for Coronavirus Disease 2019) Regulations 2021;
(ii)he or she has a cleared status (general) that is current under the Infectious Diseases (Mass Gathering Testing for Coronavirus Disease 2019) Regulations 2021 and, within the period of 24 hours before the end of the period of the live performance —
(A)he or she undergoes an approved test or approved tests; and
(B)the individual’s test result is treated under those Regulations either as negative for SARS‑CoV‑2 or an atypical finding for SARS‑CoV‑2; and
(c)every other performer, and every crew, has a cleared status at all times during the period of the live performance.
(2)  A person staging a live performance must not stage a live performance which is a rehearsal that has playing a wind musical instrument or singing as an element of the performance (whether alone or in combination with any other performance elements) unless every crew, and every performer (whether or not playing a wind musical instrument or singing and whether or not when wearing a mask), has a cleared status at all times during the period of the rehearsal.”.
Amendment of regulation 8
4.  Regulation 8 of principal Regulations is amended by inserting, immediately after paragraph (1), the following paragraph:
(1A)  However, and without limiting regulation 7A, where any performer in a live performance does any of the following during the period of the live performance:
(a)play a wind musical instrument;
(b)sing,
a person staging the live performance must take all reasonably practicable measures to ensure that the firstmentioned performer is at all times during the period of the live performance at least 2 metres away from any other performer in the live performance.”.
Amendment of regulation 10
5.  Regulation 10 of the principal Regulations is amended —
(a)by deleting paragraph (1) and substituting the following paragraphs:
(1)  Without limiting regulation 7A, a person staging a live performance must take all reasonably practicable measures to ensure that at all times during the period of the live performance, there are on or in the stage area, whether masked or unmasked —
(a)not more than 10 performers who perform by singing, and no other performer is performing by playing a wind musical instrument;
(b)not more than 10 performers who perform by playing a wind musical instrument, and no other performer is performing by singing; or
(c)not more than 10 performers, some of whom perform by singing and others by playing a wind musical instrument.
(1A)  Without limiting paragraph (1), a person staging a live performance must take all reasonably practicable measures to ensure that at all times during the period of the live performance, there are on or in the stage area, not more than the following number of performers in the live performance who are unmasked, including any performer described in paragraph (1) if unmasked:
(a)10 performers;
(b)a higher total number (but not exceeding 20) of performers as specified by the approving authority in relation to the particular live performance.”;
(b)by deleting the word “A” in paragraph (2) and substituting the words “Subject to paragraph (1A), a”; and
(c)by deleting the regulation heading and substituting the following regulation heading:
Maximum number singing, etc., or unmasked”.
Amendment of regulation 12A
6.  Regulation 12A of the principal Regulations is amended by deleting paragraph (3) and substituting the following paragraphs:
(3)  The enhanced entry controls with respect to a live performance or live performance venue means a requirement to establish and maintain, during the period of the live performance, all reasonably practicable procedures and protocols that ensure that only the following enter or remain within the live performance venue during that live performance period:
(a)an individual mentioned in paragraph (1)(c)(ii), (iii) or (iv), or any combination of such individuals, with a cleared status;
(b)an audience member with a cleared status;
(c)an audience member who is an uncleared junior, unless there are also present, in the live performance venue during that period, other audience members who are uncleared juniors and are not below the maximum permissible number of uncleared juniors for the live performance venue during that period.
(4)  The maximum permissible number of uncleared juniors for a live performance venue during the period of the live performance taking place in that venue is 20% of the total number of audience members present or who may be present within the live performance venue during that period, rounded down to the nearest whole number.”.
Amendment of regulation 13
7.  Regulation 13(1) of the principal Regulations is amended by deleting sub‑paragraph (a) and substituting the following sub‑paragraph:
(a)either —
(i)where the live performance venue is a restricted place within the meaning of the Infectious Diseases (Mass Gathering Testing for Coronavirus Disease 2019) Regulations 2021, and every crew and performer has a cleared status during the period of the live performance — 500 or a higher number specified by the approving authority under regulation 19(3) in relation to the particular live performance; or
(ii)in any other case — 50 or a higher number specified by the approving authority under regulation 19(3) in relation to the particular live performance;”.
Amendment of regulation 14
8.  Regulation 14(1) of the principal Regulations is amended by deleting sub‑paragraph (a) and substituting the following sub‑paragraph:
(a)is seated alone, or in a cohort that consists of —
(i)5 or fewer audience members each with a cleared status;
(ii)5 or fewer uncleared juniors all from the same household; or
(iii)5 or fewer individuals in total, consisting of one or more uncleared juniors (all from the same household) and other individuals with a cleared status;”.
Deletion and substitution of regulation 17
9.  Regulation 17 of the principal Regulations is deleted and the following regulation substituted therefor:
Mask wearing
17.—(1)  During the period of the live performance —
(a)a crew and a performer in a live performance must not be unmasked when he or she is on or in the stage area; and
(b)a performer in a live performance must not be unmasked when he or she is not engaged in performing in the live performance.
(2)  Paragraph (1) does not apply where the crew or performer in a live performance would otherwise be permitted under these Regulations to not wear a mask, or by a person staging the live performance in accordance with regulation 10.”.
Amendment of regulation 19
10.  Regulation 19(1) of the principal Regulations is amended by deleting the words “or 13(1)(a)(ii)” and substituting the words “or (1A)(b) or 13(1)(a)(i) or (ii)”.
Amendment of regulation 22
11.  Regulation 22 of the principal Regulations is amended —
(a)by deleting sub‑paragraph (a) of paragraph (2) and substituting the following sub‑paragraph:
(a)not more than 10 interviewees attending the media conference in person are unmasked; and”; and
(b)by deleting the regulation heading and substituting the following regulation heading:
Interviewees who may be allowed unmasked, etc.”.
Amendment of regulation 27
12.  Regulation 27 of the principal Regulations is amended by inserting, immediately after the words “not be unmasked”, the words “if 10 or more other interviewees at the same media conference are unmasked at that same time”.
Amendment of regulation 30
13.  Regulation 30 of the principal Regulations is amended —
(a)by deleting the words “no unmasked individuals” and substituting the words “not more than 10 unmasked individuals”; and
(b)by deleting the regulation heading and substituting the following regulation heading:
Maximum number of unmasked public speakers”.
Amendment of regulation 31
14.  Regulation 31 of the principal Regulations is amended by deleting paragraph (1) and substituting the following paragraphs:
(1)  Subject to paragraph (2), any individual may be unmasked when engaged in public speaking during a business event.
(2)  However, an individual must not be unmasked if 10 or more other individuals engaged in public speaking at the same business event are unmasked at that same time.”.
