Secondhand Dealers (Fees and Forms) (Amendment) Rules 2004

In exercise of the powers conferred by section 16 of the Secondhand Dealers Act, the Minister for Home Affairs hereby makes the following Rules:

Citation and commencement

1. These Rules may be cited as the Secondhand Dealers (Fees and Forms) (Amendment) Rules 2004 and shall come into operation on 1st October 2004.

Deletion and substitution of rule 3

2. Rule 3 of the Secondhand Dealers (Fees and Forms) Rules (R 1) is deleted and the following rule substituted therefor:

“Licence

3.—(1) The fee for a licence issued under section 9 of the Act shall be $150 and the fee for the transfer of a licence shall be $40.

(2) The fee payable for a change of the address of a business, or the name under which a business is carried on, shall be $20.

(3) The fee payable for each copy or replacement of a licence shall be $10.”.

Amendment of Schedule

3. The Schedule to the Secondhand Dealers (Fees and Forms) Rules is amended by deleting Forms A and B and substituting the following Forms:

Rule 5

The following conditions shall be endorsed on the back of the dealer’s licence:

CONDITIONS

1. This licence shall be kept posted up in a conspicuous place in the licensee’s shop.

2. The licensee shall exhibit a sign-board, 76 cm. x 60 cm. painted white with black lettering, over the outer door of his shop.

3. The licensee shall not sell or purchase goods before 7 a.m. or after 9 p.m.

4. The licensee shall keep the prescribed books and produce them on demand between 7 a.m. and 9 p.m. to any Magistrate, Justice of the Peace, the Licensing Officer or any police officer.

5. The licensee shall admit at any time during business hours any police officer to his premises to search for stolen property.

6. The licensee shall not deal in any stolen property or any property which he has reason to believe was illegally obtained. The licensee shall, without unnecessary delay, give information to the police of any stolen property sold or offered for sale and may detain any person offering the property for sale until the arrival of the police.

7. The licensee shall ensure that the lists of stolen property supplied to him by the police are kept in serial and chronological order for easy reference. Should the licensee fail to receive any list in the proper sequence, he shall report within 24 hours of the omission coming to his notice to the Licensing Officer.”.
