Factories Act
(Chapter 104)
Factories (Shipbuilding and Ship-repairing) (Amendment) Regulations 1998
In exercise of the powers conferred by sections 68 and 102 of the Factories Act, the Minister for Manpower hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Factories (Shipbuilding and Ship-repairing) (Amendment) Regulations 1998 and shall come into operation on 1st January 1999.
Amendment of regulation 36
2.  Regulation 36 of the Factories (Shipbuilding and Ship-repairing) Regulations (Rg 11) is amended —
(a)by deleting the words “ship repair manager” in the fourth and fifth lines of paragraph (2) and substituting the words “safety assessor”;
(b)by deleting paragraph (3);
(c)by deleting the words “from the ship repair manager” in the first and second lines of paragraph (4);
(d)by deleting the word “return” in paragraph (5) and substituting the word “forward”;
(e)by inserting, immediately before sub-paragraph (a) of paragraph (6), the following sub-paragraph:
(a)evaluate the information given to him relating to the work to be carried out and the risks and hazards involved;”; and
(f)by re-lettering the existing sub-paragraphs (a), (b) and (c) of paragraph (6) as sub-paragraphs (b), (c) and (d), respectively.
Amendment of regulation 40
3.  Regulation 40 of the Factories (Shipbuilding and Ship-repairing) Regulations is amended —
(a)by deleting the words “ship repair manager” in the fifth line of paragraph (1) and substituting the words “safety assessor”;
(b)by deleting paragraph (3);
(c)by deleting the words “together with the applicant for the hot-work permit,” in the first line of paragraph (4) (b);
(d)by inserting, immediately after paragraph (4), the following paragraph:
(4A)  An inspection referred to in paragraph (4) (b) shall be carried out together with the applicant for the permit unless the safety assessor is thoroughly familiar with the area in which the hot-work is to be carried out.”;
(e)by deleting paragraph (5) and substituting the following paragraph:
(5)  If the safety assessor is satisfied with the results of the inspection, he shall then endorse the application for the hot-work permit and forward the endorsed application to the ship repair manager.”;
(f)by inserting, immediately before sub-paragraph (a) of paragraph (7), the following sub-paragraph:
(a)evaluate the information given to him relating to the risks and hazards involved;”; and
(g)by re-lettering the existing sub-paragraphs (a) and (b) of paragraph (7) as sub-paragraphs (b) and (c), respectively.
