Patents (Amendment) Rules 2001

In exercise of the powers conferred by section 115 of the Patents Act, the Minister for Law hereby makes the following Rules:

Citation and commencement

1. These Rules may be cited as the Patents (Amendment) Rules 2001 and shall come into operation on 15th February 2001.

Amendment of First Schedule

2. The First Schedule to the Patents Rules (R 1) is amended —

(a)

by deleting “380” in items 3, 6, 7 and 8 under the heading “Amount” and substituting in each case “450”;

(b)

by deleting “41” in item 5 under the heading “Amount” and substituting “50”;

(c)

by deleting item 16 and substituting the following item:

“

16. On payment of renewal fee by means other than the electronic online system —

(a) for each year in respect of the 5th, 6th or 7th year of the patent

(b) for each year in respect of the 8th, 9th or 10th year of the patent

(d) for each year in respect of the 14th, 15th or 16th year of the patent

(e) for each year in respect of the 17th, 18th or 19th year of the patent

(f) for the 20th year of the patent

(d)

by deleting “220” in item 23 under the heading “Amount” and substituting “250”;

(e)

by deleting “63” in item 25 under the heading “Amount” and substituting “70”;

(f)

by deleting “20” in item 26 under the heading “Amount” and substituting “25”;

(g)

by deleting “220” in items 34 and 35 under the heading “Amount” and substituting in each case “280”;

(h)

by deleting “430” in item 37 under the heading “Amount” and substituting “500”;

(i)

by deleting “85” in item 45 under the heading “Amount” and substituting “100”;

(j)

by deleting “135” in item 50 under the heading “Amount” and substituting “150”; and

(k)

by deleting item 55 and substituting the following item:

“

55. On payment of renewal fee under section 53 or 54 by means other than the electronic online system —

(a) for each year in respect of the 5th, 6th or 7th year of the patent

(b) for each year in respect of the 8th, 9th or 10th year of the patent
