Prevention of Corruption
(Occupational Superannuation Scheme)
(Amendment) Regulations 2023

In exercise of the powers conferred by section 4A of the Prevention of Corruption Act 1960, the Prime Minister makes the following Regulations:

Citation and commencement

1.—(1) These Regulations are the Prevention of Corruption (Occupational Superannuation Scheme) (Amendment) Regulations 2023 and, except for regulation 41, come into operation on 1 September 2023.

(2) Regulation 41 is deemed to have come into operation on 31 December 2021.

Amendment of regulation 2

2. In the Prevention of Corruption (Occupational Superannuation Scheme) Regulations 2003 (G.N. No. S 51/2003) (called in these Regulations the principal Regulations), in regulation 2 —

(a)

in paragraph (1), before the definition of “Award Appeal Authority”, insert —

“ “2001 Scheme” means the Occupational Superannuation Scheme established for CPIB officers appointed on or after 1 November 2001 but before 1 September 2023 in accordance with these Regulations;

“2023 Scheme” means the Occupational Superannuation Scheme established for CPIB officers appointed on or after 1 September 2023 in accordance with these Regulations;”;

(b)

in paragraph (1), in the definitions of “compulsory retirement age” and “emoluments”, after “a member”, insert “of the 2001 Scheme or 2023 Scheme”;

(c)

in paragraph (1), in the definition of “compulsory retirement age”, replace “regulation 10(1)” with “regulation 10”;

(d)

in paragraph (1), in the following definitions, after “a member”, insert “of the 2001 Scheme”:

the definition of “eligible junior officer”

the definition of “eligible senior officer”

the definition of “gross salary”

the definition of “Retention Account”

the definition of “Retirement Account”;

(e)

in paragraph (1), replace the definition of “former member” with —

“ “former member of the 2001 Scheme” means an individual who —

(a)	before 1 May 2019, transfers from the service to another scheme of service in the public service; or
(b)	on or after 1 May 2019, transfers from the service to the Administrative Service,

and who, immediately before the transfer, is a member of the 2001 Scheme;”;

(f)

in paragraph (1), replace the definition of “member” with —

“ “member of the 2001 Scheme” means —

(a)

any CPIB officer appointed on or after 1 November 2001 who has not exercised the option to convert to the 2023 Scheme in accordance with regulation 38; or

(b)

any CPIB officer appointed before 1 November 2001 who —

(i)	exercised the option to convert to the 2001 Scheme under regulation 33; but
(ii)	has not exercised the option to convert to the 2023 Scheme in accordance with regulation 38;

“member of the 2023 Scheme” means —

(a)	any CPIB officer appointed on or after 1 September 2023;
(b)	any CPIB officer appointed on or after 1 November 2001 but before 1 September 2023 and who has exercised the option to convert to the 2023 Scheme in accordance with regulation 38; or
(c)	any CPIB officer appointed before 1 November 2001 who has exercised the option to convert to the 2023 Scheme under regulation 38, regardless of whether the CPIB officer had exercised the option to convert to the 2001 Scheme under regulation 33 or not;”;

(g)

in paragraph (1), in the definition of “previous pensionable service”, after “to a member”, insert “of the 2001 Scheme or 2023 Scheme”;

(h)

in paragraph (1), in the definition of “previous pensionable service”, replace “be a member” with “be such member”; and

(i)

in paragraph (2), after “any member”, insert “of the 2001 Scheme”.

Amendment of regulation 3

3. In the principal Regulations, in regulation 3 —

(a)	in paragraph (1)(a), replace “the Scheme” with “the 2001 Scheme or 2023 Scheme”; and
(b)	in paragraph (3), after “any member”, insert “of the 2001 Scheme or 2023 Scheme”.

Amendment of regulation 5

4. In the principal Regulations, in regulation 5(1), after “a member”, insert “of the 2001 Scheme or 2023 Scheme”.

Amendment of regulation 7

5. In the principal Regulations, in regulation 7(1), after “a member”, insert “of the 2001 Scheme”.

Amendment of regulation 8

6. In the principal Regulations, in regulation 8, replace “of determining the amount of contribution to be credited to the Retention Account or Retirement Account of a member, the following periods of service of the member” with “of these Regulations, the following periods of service of a member of the 2001 Scheme or 2023 Scheme”.

Amendment of regulation 9

7. In the principal Regulations, in regulation 9 —

(a)	after “reckonable service”, insert “of a member of the 2001 Scheme or 2023 Scheme”; and
(b)	in paragraphs (c), (d) and (e), replace “a member” with “the member”.

Amendment of regulation 10

8. In the principal Regulations, in regulation 10 —

(a)

in paragraphs (1) and (2), after “a member” wherever it appears, insert “of the 2001 Scheme”; and

(b)

after paragraph (2), insert —

“(3) Subject to these Regulations, a member of the 2023 Scheme is required to retire from the service on the 63rd anniversary of his birth, whether he has been confirmed in that rank or not.”.

Amendment of regulation 11

9. In the principal Regulations, in regulation 11 —

(a)	in paragraph (1), after “A member”, insert “of the 2001 Scheme”; and
(b)	in paragraph (2), replace “his conversion to the Scheme” with “her conversion to the 2001 Scheme under regulation 33”.

Replacement of Part IV heading

10. In the principal Regulations, in Part IV, replace the Part heading with —

“PART VIII

CONVERSION TO 2023 SCHEME

Application of this Part

37. This Part applies to the following persons (each called in this Part a relevant person):

(a)	any junior or senior officer appointed on or after 1 November 2001 but before 1 September 2023;
(b)	any junior or senior officer appointed before 1 November 2001 who, before that date, did not exercise the option to convert to the 2001 Scheme under regulation 33;
(c)	any junior or senior officer appointed before 1 November 2001 who, before that date, exercised the option to convert to the 2001 Scheme under regulation 33.

Option to convert to 2023 Scheme

38.—(1) Any relevant person must, subject to the conditions imposed by the Minister, be given an option to convert to the 2023 Scheme or to remain —

(a)	in the 2001 Scheme; or
(b)	in his existing scheme of service.

(2) Any option exercised by a relevant person is irrevocable except that the relevant person may be required by the Minister to revert to the pensionable service, if the relevant person was in the pensionable service prior to his conversion to the 2023 Scheme.

(3) Any option exercised by a relevant person before 1 September 2023 to join or not join the 2023 Scheme is deemed to be exercised in accordance with this regulation.

Closure of Retention Account and Retirement Account

39.—(1) If any relevant person exercises the option to convert to the 2023 Scheme —

(a)	the relevant person’s Retention Account (if any) and Retirement Account (if any) must be closed on 1 September 2023 and all contributions to those accounts must cease immediately; and
(b)	the whole amount of money standing to the credit of the relevant person on 1 September 2023 in the Retention Account (if any) and Retirement Account (if any) is to be awarded to the relevant person.

(2) The Board may, on the application of the relevant person mentioned in paragraph (1), or a person entitled to apply under paragraph (3), to withdraw the money standing to the credit of the relevant person on 1 September 2023 in the Retention Account or Retirement Account, made at any time on or after that date, authorise the payment to the applicant of the money.

(3) The following persons are entitled to apply to withdraw the money standing to the credit of the relevant person mentioned in paragraph (1) in the relevant person’s Retention Account or Retirement Account:

(a)

where the relevant person lacks capacity within the meaning of section 4 of the Mental Capacity Act 2008 —

(i)	a deputy appointed or deemed to be appointed for the relevant person by the court under that Act with power in relation to the relevant person for the purposes of these Regulations; or
(ii)	a donee under a lasting power of attorney registered under that Act with power in relation to the relevant person for the purposes of these Regulations;

(b)

after the death of the relevant person, the personal representative of the relevant person.

Deferment of payment

40. Despite any provision in these Regulations, any payment of any moneys under regulation 39 to a relevant person mentioned in regulation 39(1) or a person entitled to apply under regulation 39(3) may be deferred if —

(a)	the relevant person is being investigated for any negligent act or misconduct;
(b)	disciplinary proceedings are being contemplated or have been initiated against the relevant person for any such act of misconduct or negligence; or
(c)	criminal proceedings are being contemplated or have been instituted against the relevant person.

Unclaimed moneys

41.—(1) Where the Retention Account and the Retirement Account of a relevant person have been closed under regulation 39, and any person entitled to apply for withdrawal has not applied to withdraw the moneys in any of those accounts under regulation 39 within 12 months of the date of such closure, such amount shall be accounted for as unclaimed and shall be transferred to the Provisional Account.

(2) Where any amount has been transferred to the Provisional Account under paragraph (1), the Board shall, upon the application of any person entitled to apply for withdrawal, authorise the withdrawal by such person of the amount due to the relevant person as if it had not been transferred out of the relevant member’s account.”.

39. In the principal Regulations, in the First Schedule —

(a)	in paragraph 1, after “a member”, insert “of the 2001 Scheme”; and
(b)	in paragraph 2, replace “a member’s Retirement Account” with “the Retirement Account of a member of the 2001 Scheme”.

40. In the principal Regulations, in the Second Schedule —

(a)	in paragraph 1, replace “a member’s Retention Account” with “the Retention Account of a member of the 2001 Scheme”;
