(Chapter 70)
Customs (Duties) (Amendment No. 4) Order 2006
In exercise of the powers conferred by section 10(1) of the Customs Act, the Minister for Finance hereby makes the following Order:
Citation and commencement
1.  This Order may be cited as the Customs (Duties) (Amendment No. 4) Order 2006 and shall come into operation on 8th November 2006.
Amendment of paragraph 4
2.  Paragraph 4 of the Customs (Duties) Order (O 4) is amended —
(a)by deleting the word “and” at the end of sub-paragraph (1)(k);
(b)by deleting the full-stop at the end of sub-paragraph (l) of sub-paragraph (1) and substituting the word “; and”, and by inserting immediately thereafter the following sub-paragraph:
(m)the Republic of Chile.”;
(c)by inserting, immediately after sub-paragraph (4I), the following sub-paragraph:
(4J)  Goods shall be deemed to have originated from and be consigned direct from the Republic of Chile where they conform with the Rules of Origin set out in the Trans-Pacific Strategic Economic Partnership Agreement.”;
(d)by deleting the word “or” at the end of sub-paragraph (5)(i);
(e)by deleting the full-stop at the end of sub-paragraph (j) of sub-paragraph (5) and substituting the word “; or”, and by inserting immediately thereafter the following sub-paragraph:
(k)where the goods are from the Republic of Chile, either of the following documents issued by the producer or the exporter of the goods:
(i)a Declaration as to the Origin on the export invoice, which describes the goods in such detail as to comply with Articles 4.13.4 and 4.13.5 of the Trans-Pacific Strategic Economic Partnership Agreement, in the form set out in Part I of the Ninth Schedule;
(ii)a Certificate of Origin in the form set out in Part II of the Ninth Schedule.”; and
(f)by deleting the words “sub-paragraph (5)(a)(ii) or (i)(ii)” in sub-paragraph (7C) and substituting the words “sub-paragraph (5)(a)(ii), (i)(ii) or (k)”.
