(INVEST Plan) (Amendment No. 3)
Regulations 2013
In exercise of the powers conferred by section 3 of the Home Affairs Uniformed Services Superannuation Act, the Minister for Home Affairs hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Home Affairs Uniformed Services (INVEST Plan) (Amendment No. 3) Regulations 2013 and shall come into operation on 1st October 2013.
Amendment of regulation 2
2.  Regulation 2(1) of the Home Affairs Uniformed Services (INVEST Plan) Regulations (Rg 2) (referred to in these Regulations as the principal Regulations) is amended —
(a)by deleting the definition of “compulsory retirement age”;
(b)by inserting, immediately after the definition of “gross salary”, the following definition:
“ “INVEST contribution cessation date” means —
(a)in relation to a member who is a junior officer, the date which immediately precedes the 50th anniversary of the date of his birth; or
(b)in relation to a member who is a senior officer, the date which immediately precedes the 55th anniversary of the date of his birth;”; and
(c)by inserting, immediately after the definition of “Retirement Account”, the following definition:
“ “retirement age”, in relation to a member, means the retirement age of that member determined in accordance with regulation 10;”.
Deletion and substitution of regulation 10
3.  Regulation 10 of the principal Regulations is deleted and the following regulation substituted therefor:
Retirement age
10.—(1)  Subject to paragraphs (2), (3), (4) and (5), a member shall be required to retire from the service at the age of 55 years, whether he has been confirmed in that rank or not.
(2)  Subject to paragraph (3), where a member who is a junior officer applies, before he attains such age (being the age of 50, 51, 52, 53 or 54 years) as he may specify in the application, to retire from the service at the age specified in the application, the relevant authority may permit him to retire from the service at the age specified in the application.
(3)  Where a relevant member who is a junior officer applies, before he attains the age of 50 years, to retire from the service at that age, the relevant authority shall permit him to retire from the service at that age.
(4)  Subject to paragraph (5), where the relevant authority is of the view that it is in the interests of the uniformed service to which a member belongs for the member to continue in the service after the member has attained the age of 55 years —
(a)the relevant authority may offer to raise the age at which the member shall be required to retire from the service, to such age (being the age of 56, 57, 58, 59 or 60 years) as the relevant authority may specify; and
(b)if the member accepts the offer within such period as the relevant authority may specify, the member shall be required to retire from the service at the age specified by the relevant authority.
(5)  Where the age at which a member shall be required to retire from the service has been raised in accordance with paragraph (4), and he applies, before he attains that age, to retire from the service at an earlier age specified in the application, the relevant authority may permit him to retire from the service at the earlier age specified in the application.
(6)  In this regulation —
“relevant authority” means the Minister or any person appointed by the Minister to perform the functions and exercise the powers of the relevant authority under this regulation;
“relevant member” means a person —
(a)who, immediately before 1st October 2013, is a member; and
(b)who continues to be a member until he attains the age of 50 years.”.
Amendment of regulation 11
4.  Regulation 11(1) of the principal Regulations is amended by deleting the word “compulsory” in sub-paragraph (a).
Amendment of regulation 12
5.  Regulation 12(1) of the principal Regulations is amended —
(a)by inserting, immediately after the words “Retention Account,” in sub-paragraph (b), the words “up to the member’s INVEST contribution cessation date,”; and
(b)by inserting, immediately after the words “Retirement Account” in sub-paragraph (c), the words “, up to the member’s INVEST contribution cessation date”.
Amendment of regulation 12A
6.  Regulation 12A(1) of the principal Regulations is amended by inserting, immediately after the words “senior officer,”, the words “up to his INVEST contribution cessation date,”.
Amendment of regulation 19
7.  Regulation 19 of the principal Regulations is amended —
(a)by deleting the words “before his compulsory retirement age but” in paragraph (1)(e); and
(b)by deleting the words “his compulsory retirement age” in paragraph (4) and substituting the words “the relevant date”.
Amendment of regulation 19B
8.  Regulation 19B of the principal Regulations is amended —
(a)by deleting the words “before his compulsory retirement age but” in paragraph (1)(e); and
(b)by deleting the words “his compulsory retirement age” in paragraph (5) and substituting the words “the relevant date”.
Amendment of First Schedule
9.  The First Schedule to the principal Regulations is amended —
(a)by deleting the words “but not beyond the member’s compulsory retirement age” in the first column of the table in paragraph 1 and substituting the words “up to the member’s INVEST contribution cessation date”;
(b)by deleting the words “but not beyond the member’s compulsory retirement age” in the first column of the table in paragraph 3 and substituting the words “up to the member’s INVEST contribution cessation date”; and
(c)by deleting paragraph 4 and substituting the following paragraph:
4.  Notwithstanding paragraph 3, an additional 6% contribution shall be credited to the Retirement Account of a Senior Police Officer who is a Superscale appointment holder, up to his INVEST contribution cessation date.”.
Amendment of Second Schedule
10.  Paragraph 4 of the Second Schedule to the principal Regulations is amended —
(a)by inserting, immediately after “50” in the first column of the table relating to “Vesting for Junior Officers”, the words “and above”; and
(b)by inserting, immediately after “55” in the first column of the table relating to “Vesting for Senior Officers”, the words “and above”.
