(Declaration of Healthcare Establishments)
Order 2022
In exercise of the powers conferred by the definition of “healthcare establishment” in section 2 of the Private Hospitals and Medical Clinics Act 1980, the Minister for Health makes the following Order:
Citation and commencement
1.  This Order is the Private Hospitals and Medical Clinics (Declaration of Healthcare Establishments) Order 2022 and comes into operation on 12 September 2022.
Certain human tissue banks declared as healthcare establishments
2.—(1)  For the purposes of the definition of “healthcare establishment” in section 2 of the Act, any premises used or intended to be used for the handling, processing and storage of any specified human tissue for the purpose of distributing for transplantation, being services that are related to the treatment of persons suffering from any disease, injury or disability, is declared to be a healthcare establishment.
(2)  In this paragraph, “specified human tissue” means any human tissue derived or obtained from the body of a person, other than —
(a)whole human blood; and
(b)the whole blood (including haematopoietic progenitor cells) remaining in the placental and umbilical cord blood vessels after an umbilical cord has been clamped.
