Fisheries (Fishing Vessels) (Amendment No. 2) Rules 2004

In exercise of the powers conferred by section 27 of the Fisheries Act, the Minister for National Development hereby makes the following Rules:

Citation and commencement

1. These Rules may be cited as the Fisheries (Fishing Vessels) (Amendment No. 2) Rules 2004 and shall come into operation on 1st December 2004.

Deletion and substitution of rule 4

2. Rule 4 of the Fisheries (Fishing Vessels) Rules (R 2) is deleted and the following rule substituted therefor:

“Inspection of vessel

4.—(1) In determining whether to issue or refuse to issue a licence, the Director-General may consider the fitness of the fishing vessel for its intended use.

(2) For the purpose of paragraph (1), the Director-General may —

(a)	require any fishing vessel for which an application for a licence is made to be brought to any place for inspection; and
(b)	cause the fishing vessel to be inspected by an authorised officer.”.

Miscellaneous amendments

3. The Fisheries (Fishing Vessels) Rules are amended —

(a)

by deleting the word “Director” wherever it appears in the following provisions and substituting in each case the word "Director-General":

“Rules 3(1), (2)(c), (3), (4) and (5), 6(1), (3) and (6), 7(1) and (2), 8(1), (4) and (5), 9, 10(2) and (3), 13(1), (2) (f) and (3) and 14;”.

(b)

by deleting the words “fishery officer” in the following provisions and substituting in each case the words “authorised officer”:

“Rules 8(2) and (3) and 12(2) and (3);”.

(c)

by deleting the words “a fishery officer” in the following provisions and substituting in each case the words “an authorised officer”:

“Rules 10(1) and 12(1); and”.

(d)

by deleting the words “A fishery officer” in rule 11 and substituting the words “An authorised officer”.
