(Amendment)
Rules 2012
In exercise of the powers conferred by section 20(1) of the Poisons Act, the Minister for Health hereby makes the following Rules:
Citation and commencement
1.  These Rules may be cited as the Poisons (Amendment) Rules 2012 and shall come into operation on 1st January 2013.
Amendment of rule 2
2.  Rule 2(1) of the Poisons Rules (R 1) is amended —
(a)by inserting, immediately after the definitions of “ “British Pharmacopoeia” and “Pharmaceutical Codex” ”, the following definition:
“ “Chinese proprietary medicine” has the same meaning as in the Medicines (Traditional Medicines, Homoeopathic Medicines and other Substances) (Exemption) Order (Cap. 176, O 6);”; and
(b)by inserting, immediately after the definition of “licensed person”, the following definition:
“ “medical device” means a medical device referred to in the First Schedule to the Health Products Act (Cap. 122D);”.
Amendment of Second Schedule
3.  The Second Schedule to the Poisons Rules is amended —
(a)by inserting, immediately after the word “matches;” in Group I, the words “medical devices;”;
(b)by inserting, immediately after the words “treatment of human ailments” under the heading “Substance or article in which exempted” against the item “Berberine; its quarternary compounds; their salts” in Group II, the words “; Chinese proprietary medicines”; and
(c)by deleting the item “Coptis Teeta” and its entry relating thereto in Group II.
