Hydrogen Cyanide (Fumigation) Act

Hydrogen Cyanide (Fumigation) (Amendment) Regulations 2006

In exercise of the powers conferred by section 2 of the Hydrogen Cyanide (Fumigation) Act, the Minister for the Environment and Water Resources hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Hydrogen Cyanide (Fumigation) (Amendment) Regulations 2006 and shall come into operation on 1st January 2007.

Amendment of regulation 2

2. Regulation 2 of the Hydrogen Cyanide (Fumigation) Regulations (Rg 1) (referred to in these Regulations as the principal Regulations) is amended by deleting the definition of “Commissioner” and substituting the following definitions:

“ “Agency” means the National Environment Agency established under the National Environment Agency Act (Cap. 195);

“authorised officer” means any person appointed by the Director-General under section 3(2) of the Environmental Public Health Act (Cap. 95) to be an authorised officer;

“Director-General” means the Director-General of Public Health appointed under section 3(1) of the Environmental Public Health Act;”.

Amendment of regulation 12

3. Regulation 12 of the principal Regulations is amended by deleting “$170” in paragraph (e) and substituting “$180”.

Amendment of regulation 16

4. Regulation 16 (1) of the principal Regulations is amended by deleting the words “Port of Singapore Authority” and substituting the words “Maritime and Port Authority of Singapore”.

New regulation 26

5. The principal Regulations are amended by inserting, immediately after regulation 25, the following regulation:

“Fees payable to Agency

26. All fees collected under these Regulations shall be paid to the Agency.”.

Amendment of Schedule

6. The Schedule to the principal Regulations is amended ––

(a)	by deleting the words “The Commissioner of Public Health, Singapore.” in Forms A, B and D and substituting in each case the words “The Director-General of Public Health, Singapore.”;
(b)	by deleting the words “Commissioner of Public Health, Ministry of the Environment.” in Forms C and F and substituting in each case the words “Director-General of Public Health, Singapore.”; and
(c)	by deleting the words “Port of Singapore Authority.” in Form D and substituting the words “Maritime and Port Authority of Singapore.”.

Miscellaneous amendments

7. The principal Regulations are amended —

(a)

by deleting the word “Commissioner” wherever it appears in the following provisions and substituting in each case the word “Director-General”:

Regulations 5, 6, 7, 9, 11, 12 (b) and (c), 13, 19(1) and (4), 21, 22(b) and 23(b); and

(b)

by deleting the word “Commissioner” wherever it appears in the following provisions and substituting in each case the words “Director-General or an authorised officer”:

Regulations 10, 16(1) and (2), 24 and 25.
