Police Force Act 2004
Police (Amendment) Regulations 2022
In exercise of the powers conferred by section 117 of the Police Force Act 2004, the Minister for Home Affairs makes the following Regulations:
Citation and commencement
1.  These Regulations are the Police (Amendment) Regulations 2022 and come into operation on 2 September 2022.
Amendment of regulation 2
2.  In regulation 2(a) of the Police Regulations (Rg 1) —
(a)replace “Senior Police Officers” with “Ranks of inspector and above”; and
(b)after sub-paragraph (ix), insert —
(ixa)Chief Inspector”.
New regulation 2A
3.  In Part II of the Police Regulations, after regulation 2, insert —
Prescribed grade for delegation of powers
2A.—(1)  For the purpose of section 17(1)(b) of the Act, the prescribed grade is MX10 for a Management Executive Officer and the equivalent grade for any other public officer.
(2)  For the purpose of section 17(2)(b) of the Act, the prescribed grade is MX12 for a Management Executive Officer and the equivalent grade for any other public officer.”.
Amendment of regulation 3
4.  In regulation 3 of the Police Regulations, replace paragraph (1) with —
(1)  A complaint against a police officer must —
(a)be made in writing; and
(b)unless the complaint is made electronically, be read over to the person making the complaint and signed by that person.”.
Amendment of regulation 4
5.  In regulation 4 of the Police Regulations, replace paragraph (1) with —
(1)  If, as a result of an investigation, a disciplinary offence is disclosed against a police officer below the rank of inspector, then —
(a)unless the case is earlier referred for prosecution under sub‑paragraph (b) and a prosecution ensues thereafter, the police officer may be charged and the police officer must attend a disciplinary proceeding in accordance with regulation 5; or
(b)the police officer may be prosecuted under section 41(1) of the Act following a referral by the Commissioner to the Public Prosecutor.”.
New regulation 7A
6.  After regulation 7 of the Police Regulations, insert —
Prescribed fine for committing disciplinary offence
7A.  For the purpose of section 40(4)(a) of the Act, the prescribed amount is —
(a)for a police officer who has attained or will, within 2 years after the order to pay the fine, attain the maximum of the police officer’s current salary scale or salary range, an amount equal to the last annual increment provided in the police officer’s salary scale or salary range; and
(b)for any other police officer, an amount equal to the total annual increments the police officer would receive in a period of 2 years after the order to pay the fine.”.
Amendment of regulation 14
7.  In regulation 14 of the Police Regulations, delete paragraph (1).
Replacement of heading of Part V
8.  In Part V of the Police Regulations, replace the Part heading with —
WELFARE ASSOCIATIONS”.
Replacement of regulation 18
9.  Regulation 18 of the Police Regulations is replaced with —
Application
18.  This Part applies to any association established for the welfare of police officers, special police officers or any non‑police personnel performing duties in the Police Force.”.
Amendment of regulation 19
10.  In regulation 19 of the Police Regulations —
(a)replace “police association” with “association”;
(b)in paragraph (g)(ii), replace “at least one‑quarter of the total number of the members of the association” with “a number of the members of the association to be decided by the committee of the association”;
(c)in paragraph (j), after “show of hands”, insert “or written means (electronic or otherwise)”;
(d)in paragraph (k), replace “police officers” with “persons”;
(e)replace paragraph (m) with —
(m)the Commissioner to be given, upon the Commissioner’s request —
(i)notice of any meeting of the association or the committee of the association; and
(ii)copies of the minutes of such a meeting;”; and
(f)in paragraph (n), replace “in Force Orders 7 days’ notice” with “7 days’ written notice”.
Amendment of regulation 20
11.  In regulation 20 of the Police Regulations —
(a)in paragraph (1)(b), after “police officers”, insert “, special police officers or non‑police personnel performing duties in the Police Force”;
(b)in paragraph (2), replace “police officer” with “person”; and
(c)in paragraph (2), replace “police association” with “association”.
Amendment of regulation 25
12.  In regulation 25 of the Police Regulations —
(a)in paragraph (1), replace “wreath of padi sheaves” with “paddy wreath”;
(b)in paragraphs (1) and (2), replace “scroll” with “ribbon”;
(c)in paragraph (2), replace “wreath of padi sheaves in silver” with “paddy wreath”; and
(d)in paragraph (2), replace “silver” with “white”.
Amendment of regulation 26
13.  In regulation 26 of the Police Regulations, delete paragraph (s).
