(Regulated GHG Works)
Order 2022
In exercise of the powers conferred by section 40K of the Environmental Protection and Management Act 1999, the Minister for Sustainability and the Environment, after consulting the National Environment Agency, makes the following Order:
Citation and commencement
1.  This Order is the Environmental Protection and Management (Regulated GHG Works) Order 2022 and comes into operation on 1 October 2022.
Definitions
2.  In this Order, unless the context otherwise requires —
“charging”, in relation to any specified goods, means the charging of the specified goods with any refrigerant;
“decommissioning”, in relation to any specified goods, means the final shut‑down and removal from operation or usage of the specified goods or any part of the specified goods (including any gas carrying conductor or circuit) that contains or is designed to contain any greenhouse gas, but not if such shut‑down or removal does not involve the use or handling of any greenhouse gas;
“maintenance”, in relation to any specified goods, means any activity that involves breaking into any part of the specified goods (including any gas carrying conductor or circuit) that contains or is designed to contain any greenhouse gas, including in the course of any of the following:
(a)supplying any such part of the specified goods with any refrigerant or any constituent of the refrigerant;
(b)removing from any such part of the specified goods any refrigerant or any constituent of the refrigerant;
(c)removing any such part of the specified goods;
(d)reassembling any such part of the specified goods;
(e)repairing any leak in any such part of the specified goods,
but not any such activity that does not involve the use or handling of any greenhouse gas;
“refrigerant” means any greenhouse gas, or blend or mixture of substances (at least one of which is a greenhouse gas), that —
(a)is used for heat transfer in a refrigerating system;
(b)absorbs heat when the temperature and pressure of the greenhouse gas or blend or mixture of substances is low;
(c)rejects heat when the temperature and pressure of the greenhouse gas or blend or mixture of substances is high; and
(d)usually changes from a gaseous state to a liquid state, and vice versa in a refrigerating system;
“specified goods” means any specified water-cooled chiller;
“specified water‑cooled chiller” means any electrically driven water‑cooled chiller that requires for its use or operation a refrigerant, where a greenhouse gas, or a blend or mixture of greenhouse gases, contained in the refrigerant, has a global warming potential of more than 15;
“water‑cooled chiller” has the meaning given by Part 2 of the Second Schedule to the Environmental Protection and Management (Prescribed Regulated Goods) Order 2022 (G.N. No. S 272/2022).
Regulated GHG works
3.  The GHG works specified in the Schedule are regulated GHG works for the purposes of Part 10A of the Act, from and including the date specified opposite each of such works.
