Merchant Shipping Act

Merchant Shipping (Safety Convention) (Amendment No. 2) Regulations 2010
In exercise of the powers conferred by section 100 of the Merchant Shipping Act, the Maritime and Port Authority of Singapore, with the approval of the Minister for Transport, hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Merchant Shipping (Safety Convention) (Amendment No. 2) Regulations 2010 and shall come into operation on 1st January 2011.
Amendment of Regulation 3-5 of Chapter II-1
2.  Regulation 3-5 of Chapter II-1 of the Merchant Shipping (Safety Convention) Regulations (Rg 11) (referred to in these Regulations as the principal Regulations) is amended by deleting paragraph (b) and substituting the following paragraph:
(b)  For all ships, new installation of materials which contain asbestos shall be prohibited.”.
Amendment of Regulation 35-1 of Chapter II-1
3.  Regulation 35-1 of Chapter II-1 of the principal Regulations is amended by inserting, immediately after sub-paragraph (2) of paragraph (b)(vi), the following sub-paragraph:
(3)  Provisions for the drainage of closed vehicle and ro-ro spaces and special category spaces shall also comply with paragraphs (f)(i)(4) and (f)(i)(5) of Regulation 20 of Chapter II-2.”.
Amendment of Regulation 1 of Chapter II-2
4.  Regulation 1 of Chapter II-2 of the principal Regulations is amended by inserting, immediately after sub-paragraph (iii) of paragraph (b), the following sub-paragraph:
(iv)The following ships, with cargo spaces intended for the carriage of packaged dangerous goods, shall comply with paragraph (c) of Regulation 19, except when carrying dangerous goods specified as classes 6.2 and 7 and dangerous goods in limited quantities1 and excepted quantities2 in accordance with tables 19.1 and 19.3, not later than the date of the first renewal survey on or after 1st January 2011:
1  Refer to chapter 3.4 of the IMDG Code (as defined in Regulation 1 of Chapter VII).
2  Refer to chapter 3.5 of the IMDG Code (as defined in Regulation 1 of Chapter VII).
(1)cargo ships of 500 tons and upwards and passenger ships constructed on or after 1st September 1984 but before 1st January 2011; and
(2)cargo ships of less than 500 tons constructed on or after 1st February 1992 but before 1st January 2011,
and notwithstanding these provisions:
(3)cargo ships of 500 tons and upwards and passenger ships constructed on or after 1st September 1984 but before 1st July 1986 need not comply with paragraph (c)(iii) of Regulation 19 provided that they comply with paragraph (b)(iii) of Regulation 54 of Chapter II-2 of the Merchant Shipping (Safety Convention) Regulations 1984 of Chapter II-2 of the (G.N. No. S 219/84)3;
3  Regulation 54Merchant Shipping (Safety Convention) Regulations 1984 (G.N. No. S 219/84) was introduced by amendments adopted by Resolution MSC.1(XLV) Annex 3.
(4)cargo ships of 500 tons and upwards and passenger ships constructed on or after 1st July 1986 but before 1st February 1992 need not comply with paragraph (c)(iii) of Regulation 19 provided that they comply with paragraph (b)(iii) of Regulation 54 of Chapter II-2 of the Merchant Shipping (Safety Convention) Regulations 1984 (G.N. No. S 219/84) as amended by the Merchant Shipping (Safety Convention) (Amendment) Regulations 1986 of Chapter II-2 of the (G.N. No. S 139/86)4;
4  Regulation 54Merchant Shipping (Safety Convention) Regulations 1984 (G.N. No. S 219/84) as amended by the Merchant Shipping (Safety Convention) (Amendment) Regulations 1986 (G.N. No. S 139/86) was introduced by amendments adopted by Resolution MSC.6(48) Annex 4.
(5)cargo ships of 500 tons and upwards and passenger ships constructed on or after 1st September 1984 but before 1st July 1998 need not comply with paragraphs (c)(x)(1) and (c)(x)(2) of Regulation 19; and
(6)cargo ships of less than 500 tons constructed on or after 1st February 1992 but before 1st July 1998 need not comply with paragraphs (c)(x)(1) and (c)(x)(2) of Regulation 19.”.
Amendment of Regulation 16 of Chapter II-2
5.  Regulation 16 of Chapter II-2 of the principal Regulations is amended by deleting the words “the Code of Safe Practice for Solid Bulk Cargoes” in paragraph ( b)(i) and substituting the words “the International Maritime Solid Bulk Cargoes (IMSBC) Code”.
Amendment of Regulation 19 of Chapter II-2
6.  Regulation 19 of Chapter II-2 of the principal Regulations is amended —
(a)by inserting, immediately after the words “except when carrying dangerous goods in limited quantities**” in paragraph (b)(i), the words “and excepted quantities5”;
(b)by inserting, immediately after the word “Ventilation” in the heading of paragraph (c)(iv), the word “arrangement”;
(c)by inserting, immediately after the words “Regulation 10(j)” in paragraph (c)(vi)(1), the words “and shall be selected taking into account the hazards associated with the chemicals being transported and the standards developed by the Organisation according to the class and physical state6”;
(d)by inserting, immediately after the words “limited quantities” in paragraph (d), the words “and excepted quantities”;
(e)by deleting the existing references “3.1.1”, “3.1.2”, “3.1.3”, “3.1.4”, “3.2”, “3.3”, “3.4.1”, “3.4.2”, “3.5”, “3.6.1”, “3.6.2”, “3.7”, “3.8”, “3.9”, “3.10.1” and “3.10.2” in the first column of Table 19.1 and substituting the references “(c)(i)(1)”, “(c)(i)(2)”, “(c)(i)(3)”, “(c)(i)(4)”, “(c)(ii)”, “(c)(iii)”, “(c)(iv)(1)”, “(c)(iv)(2)”, “(c)(v)”, “(c)(vi)(1)”, (c)(vi)(2)”, “(c)(vii)”, “(c)(viii)”, “(c)(ix)”, “(c)(x)(1)” and “(c)(x)(2)”, respectively;
(f)by deleting note 1 in the Notes to Table 19.1 and substituting the following note:
(1)For classes 4 and 5.1 solids not applicable to closed freight containers.
For classes 2, 3, 6.1 and 8 when carried in closed freight containers, the ventilation rate may be reduced to not less than two air changes per hour.
For classes 4 and 5.1 liquids when carried in closed freight containers, the ventilation rate may be reduced to not less than two air changes per hour.
For the purpose of this requirement, a portable tank is a closed freight container.”.
(g)by deleting the existing references “3.1.1”, “3.1.2”, “3.2”, “3.4.1”, “3.4.2”, “3.4.3”, “3.6” and “3.8” in the first column of Table 19.2 and substituting the references “(c)(i)(1)”, “(c)(i)(2)”, “(c)(ii)”, “(c)(iv)(1)”, “(c)(iv)(2)”, “(c)(iv)(3)”, “(c)(vi)” and “(c)(viii)”, respectively;
(h)by deleting the words “the Code of Safe Practice for Solid Bulk Cargoes adopted by resolution A.434(XI)” in note 10 in the Notes to Table 19.2 and substituting the words “the International Maritime Solid Bulk Cargoes (IMSBC) Code”; and
(i)by deleting Table 19.3 and substituting the following Table:
“ UNKNOWN”.
Amendment of Regulation 18 of Chapter V
7.  Regulation 18 of Chapter V of the principal Regulations is amended —
(a)by deleting the full-stop at the end of the last reference to the footnote of paragraph (b) and substituting the following word “; and”; and
(b)by inserting, immediately after the last reference to the footnote of paragraph (b), the following reference:
Performance standards for a bridge navigational watch alarm system (BNWAS) (resolution MSC.128(75)).”.
Amendment of Regulation 19 of Chapter V
8.  Regulation 19 of Chapter V of the principal Regulations is amended —
(a)by deleting sub-paragraph (4) of paragraph (b)(i) and substituting the following sub-paragraph:
(4)  nautical charts and nautical publications to plan and display the ship’s route for the intended voyage and to plot and monitor positions throughout the voyage; an electronic chart display and information system (ECDIS) is also accepted as meeting the chart carriage requirements of this sub-paragraph; ships to which paragraph (b)(x) applies shall comply with the carriage requirements for ECDIS detailed therein;”;
(b)by deleting the full-stop at the end of sub-paragraph (2) of paragraph (b)(ii) and substituting a semi-colon, and by inserting immediately thereafter the following sub-paragraphs:
(3)  a bridge navigational watch alarm system (BNWAS), as follows:
(A)cargo ships of 150 tons and upwards and passenger ships irrespective of size constructed on or after 1st July 2011;
(B)passenger ships irrespective of size constructed before 1st July 2011, not later than the first survey7 after 1st July 2012;

(C)cargo ships of 3,000 tons and upwards constructed before 1st July 2011, not later than the first survey8 after 1st July 2012;

(D)cargo ships of 500 tons and upwards but less than 3,000 tons constructed before 1st July 2011, not later than the first survey9 after 1st July 2013; and
9  Refer to the Unified interpretation of the term “first survey” referred to in SOLAS regulations (MSC.1/Circ.1290).
(E)cargo ships of 150 tons and upwards but less than 500 tons constructed before 1st July 2011, not later than the first survey10 after 1st July 2014.

The bridge navigational watch alarm system shall be in operation whenever the ship is underway at sea;
(4)  a bridge navigational watch alarm system (BNWAS) installed prior to 1st July 2011 may subsequently be exempted from full compliance with the standards adopted by the Organisation11, at the discretion of the Director.”; and

(c)by inserting, immediately after sub-paragraph (ix) of paragraph (b), the following sub-paragraphs:
(x)Ships engaged on international voyages shall be fitted with an Electronic Chart Display and Information System (ECDIS) as follows:
(1)passenger ships of 500 tons and upwards constructed on or after 1st July 2012;
(2)tankers of 3,000 tons and upwards constructed on or after 1st July 2012;
(3)cargo ships, other than tankers, of 10,000 tons and upwards constructed on or after 1st July 2013;
(4)cargo ships, other than tankers, of 3,000 tons and upwards but less than 10,000 tons constructed on or after 1st July 2014;
(5)passenger ships of 500 tons and upwards constructed before 1st July 2012, not later than the first survey12 on or after 1st July 2014;

(6)tankers of 3,000 tons and upwards constructed before 1st July 2012, not later than the first survey13 on or after 1st July 2015;

(7)cargo ships, other than tankers, of 50,000 tons and upwards constructed before 1st July 2013, not later than the first survey14 on or after 1st July 2016;
14  Refer to the Unified interpretation of the term “first survey” referred to in SOLAS regulations (MSC.1/Circ. 1290).
(8)cargo ships, other than tankers, of 20,000 tons and upwards but less than 50,000 tons constructed before 1st July 2013, not later than the first survey15 on or after 1st July 2017; and

(9)cargo ships, other than tankers, of 10,000 tons and upwards but less than 20,000 tons constructed before 1st July 2013, not later than the first survey16 on or after 1st July 2018.

(xi)The Director may exempt ships from the application of the requirements of sub-paragraph (x) when such ships will be taken permanently out of service within 2 years after the implementation date specified in sub-paragraphs (5) to (9) of sub-paragraph (x).”.
Amendment of heading to Chapter VI
9.  Chapter VI of the principal Regulations is amended by deleting the Chapter heading and substituting the following Chapter heading:
CARRIAGE OF CARGOES AND OIL FUELS”.
Amendment of Regulation 1 of Chapter VI
10.  Regulation 1 of Chapter VI of the principal Regulations is amended —
(a)by deleting the word “This” in paragraph (a) and substituting the words “Unless expressly provided otherwise, this”;
(b)by deleting the word “; and” at the end of paragraph (b)(ii) and substituting a full-stop; and
(c)by deleting sub-paragraph (iii) of paragraph (b).
New Regulations 1-1 and 1-2 of Chapter VI
11.  Chapter VI of the principal Regulations is amended by inserting, immediately after Regulation 1, the following Regulations:

Definitions
  For the purpose of this Chapter, unless expressly provided otherwise, the following definitions shall apply:
(a)“IMSBC Code” means the International Maritime Solid Bulk Cargoes (IMSBC) Code adopted by the Maritime Safety Committee of the Organisation by resolution MSC.268(85), as may be amended by the Organisation, provided that such amendments are adopted, brought into force and take effect in accordance with the provisions of article VIII of the present Convention concerning the amendment procedures applicable to the Annex other than Chapter I.
(b)“Solid bulk cargo” means any cargo, other than liquid or gas, consisting of a combination of particles, granules or any larger pieces of material generally uniform in composition, which is loaded directly into the cargo spaces of a ship without any intermediate form of containment.

Requirements for carriage of solid
bulk cargoes other than grain
  The carriage of solid bulk cargoes other than grain shall be in compliance with the relevant provisions of the IMSBC Code.”.
Amendment of Regulation 2 of Chapter VI
12.  Regulation 2 of Chapter VI of the principal Regulations is amended —
(a)by inserting the word “and” at the end of paragraph (b)(i); and
(b)by deleting sub-paragraphs (ii) and (iii) of paragraph (b) and substituting the following sub-paragraph:
(ii)in the case of solid bulk cargo, information as required by section 4 of the IMSBC Code.”.
Amendment of Regulation 3 of Chapter VI
13.  Regulation 3 of Chapter VI of the principal Regulations is amended by inserting, immediately after the words “When transporting a” in paragraph (a), the word “solid”.
Deletion and substitution of Regulation 5-1 of Chapter VI
14.  Regulation 5-1 of Chapter VI of the principal Regulations is deleted and the following Regulation substituting therefor:

Material Safety Data Sheets
  Ships carrying oil or oil fuel, as defined in Regulation 1 of Annex 1 of the International Convention for the Prevention of Pollution from Ships, 1973, as modified by the Protocol of 1978 relating thereto, shall be provided with material safety data sheets, based on the recommendations developed by the Organisation17, prior to the loading of such oil as cargo in bulk or bunkering of oil fuel.”.

Amendment of heading to Part B of Chapter VI
15.  The principal Regulations are amended by deleting the heading to Part B of Chapter VI and substituting the following heading:
Special Provisions for Solid Bulk Cargoes”.
Amendment of Regulation 6 of Chapter VI
16.  Regulation 6 of Chapter VI of the principal Regulations is amended —
(a)by inserting, immediately after the words “Prior to loading a” in paragraph (a), the word “solid”; and
(b)by deleting paragraphs (b) and (c).
Amendment of Regulation 7 of Chapter VI
17.  Regulation 7 of Chapter VI of the principal Regulations is amended —
(a)by inserting, immediately after the words “Stowage of” in the regulation heading, the word “Solid”;
(b)by deleting paragraphs (d) and (e); and
(c)by re-lettering the existing paragraphs (f), (g) and (h) as paragraphs (d), (e) and (f), respectively.
Amendment of Regulation 7-1 of Chapter VII
18.  Regulation 7-1 of Chapter VII of the principal Regulations is amended by deleting the words “and the relevant Sections and the related parts of Appendix B of the Code of Safe Practice for Solid Bulk Cargoes (BC Code) adopted by the Organisation and as amended and adopted by the Organisation from time to time” in paragraph (c).
New Regulation 7-5 of Chapter VII
19.  Chapter VII of the principal Regulations is amended by inserting, immediately after Regulation 7-4, the following Regulation:

Requirements for Carriage of Dangerous Goods
in Solid Form in Bulk
  The carriage of dangerous goods in solid form in bulk shall be in compliance with the relevant provisions of the IMSBC Code, as defined in paragraph (a) of Regulation 1-1 of Chapter VI.”.
Amendment of Second Schedule
20.  The Second Schedule to the principal Regulations is amended —
(a)by inserting, immediately after item 12 in Section 5 of the Record of Equipment for the Passenger Ship Safety Certificate (Form P), the following items:
