(Bicycles) (Amendment)
Rules 2022

In exercise of the powers conferred by section 140 of the Road Traffic Act 1961, the Minister for Home Affairs makes the following Rules:

Citation and commencement

1. These Rules are the Road Traffic (Bicycles) (Amendment) Rules 2022 and come into operation on 16 October 2022.

Amendment of rule 2

2. In rule 2 of the Road Traffic (Bicycles) Rules (R 3) (called in these Rules the principal Rules) —

(a)

before the definition of “hours of darkness”, insert —

“ “full-day bicycle lane” has the meaning given by rule 7(11B) of the Road Traffic (Traffic Signs) Rules (R 33);”; and

(b)

after the definition of “hours of darkness”, insert —

“ “part-day bicycle lane” has the meaning given by rule 7(11AA) of the Road Traffic (Traffic Signs) Rules.”.

Amendment of rule 7

3. In rule 7 of the principal Rules, delete paragraph (6).

Amendment of rule 7A

4. In rule 7A of the principal Rules —

(a)

in paragraph (1), replace “paragraph (2)” with “paragraphs (2) and (2A)”; and

(b)

after paragraph (2), insert —

“(2A) Paragraph (1) does not apply to or in relation to —

(a)	a section of a road that is a full-day bicycle lane; and
(b)	a section of a road that is a part-day bicycle lane, on a Sunday at any time between 5 a.m. and 11 a.m.”.

New rule 7B

5. After rule 7A of the principal Rules, insert —

“Bicycle lanes

7B.—(1) If there is a full-day bicycle lane on a road, a person must not ride a bicycle, power‑assisted bicycle, trishaw or tricycle on a part of the road that is not the full‑day bicycle lane (unless there is a reasonable excuse for the person to do so).

(2) If there is a part-day bicycle lane on a road, a person must not ride a bicycle, power‑assisted bicycle, trishaw or tricycle on a part of the road that is not the part‑day bicycle lane, on a Sunday at any time between 5 a.m. and 11 a.m. (unless there is a reasonable excuse for the person to do so).”.
