Regulations 2016

In exercise of the powers conferred by section 23(11) of the Public Transport Council (Amendment) Act 2015, the Minister for Transport makes the following Regulations:

Citation and commencement

1. These Regulations are the Public Transport Council (Amendment) Act 2015 (Savings and Transitional Provisions) Regulations 2016 and come into operation on 29 February 2016.

Appeal against penalty fee

2.—(1) Where —

(a)	an individual is required before 29 February 2016 by a public transport official to pay a penalty fee under section 24C of the Public Transport Council Act (Cap. 259B) as in force immediately before that date; and
(b)	the period for the individual to appeal against that requirement to pay the penalty fee is current on that date,

the individual may appeal against that requirement as if section 18 of the Public Transport Council (Amendment) Act 2015 had not been enacted.

(2) Where —

(a)	an appeal has been made to the Council under section 24C(4) of the Public Transport Council Act as in force immediately before 29 February 2016; and
(b)	the appeal has not been dealt with, or disposed of, immediately before that date,

the Council may continue to deal with, and dispose of, the appeal as if section 18 of the Public Transport Council (Amendment) Act 2015 had not been enacted.
