Building and Construction Authority
(Registration of Construction Personnel)
(Amendment) Regulations 2012
In exercise of the powers conferred by section 35 of the Building and Construction Authority Act, the Building and Construction Authority, with the approval of the Minister for National Development, hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Building and Construction Authority (Registration of Construction Personnel) (Amendment) Regulations 2012 and shall come into operation on 1st April 2012.
Amendment of regulation 2
2.  Regulation 2(1) of the Building and Construction Authority (Registration of Construction Personnel) Regulations 2008 (G.N. No. S 642/2008) (referred to in these Regulations as the principal Regulations) is amended —
(a)by deleting the words “, and any reference in these Regulations to a numbered form shall be construed as a reference to the current version of the form bearing the corresponding number which is displayed at that website” in paragraph (b) of the definition of “appropriate form”;
(b)by inserting, immediately after the definition of “Building and Construction Authority Academy”, the following definition:
“ “building works” has the same meaning as in section 2(1) of the Building Control Act (Cap. 29);”;
(c)by deleting the definition of “construction personnel” and substituting the following definition:
“ “construction personnel” means a natural person who is —
(a)a construction supervisor of any class;
(b)a construction foreman of any class; or
(c)a construction tradesman of any class;”;
(d)by inserting, immediately after the definition of “construction plant operation works”, the following definition:
“ “construction supervisor” has the same meaning as in section 29H(5) of the Building Control Act;”;
(e)by inserting, immediately after the definition of “lift installation”, the following definition:
“ “mechanical and electrical works” —
(a)means any work performed or carried out to install any mechanical or electrical installation; and
(b)includes the installing, constructing, erecting, repairing or the altering of the mechanical or electrical installation or the replacing of any part thereof or the adding of any part thereto or the carrying out of any work thereon for the maintenance thereof of such installation; but
(c)does not include work in relation to the manufacturing of such installation;”;
(f)by deleting the definition of “reinforced concrete works” and substituting the following definition:
“ “reinforced concrete works” means the on-site fabrication, installation or erection of formwork and steel reinforcement for reinforced concrete work, including —
(a)fabrication (both on-site or off-site) of pre‑cast concrete components; and
(b)installation of pre-cast concrete components;”; and
(g)by inserting, immediately after the definition of “structural steel works”, the following definition:
“ “structural works” has the same meaning as in section 2(1) of the Building Control Act;”.
Amendment of regulation 3
3.  Regulation 3 of the principal Regulations is amended —
(a)by inserting, immediately before paragraph (a), the following paragraph:
(a)a construction supervisor;”; and
(b)by re-lettering the existing paragraphs (a) and (b) as paragraphs (b) and (c), respectively.
New regulation 5A
4.  The principal Regulations are amended by inserting, immediately after regulation 5, the following regulation:
Classes of construction supervisor
5A.  A construction supervisor may be registered according to one or more of the classes of works, connected with building works, specified in Part III of the Schedule that he oversees the execution or performance thereof, for or on behalf of another person, for a fixed sum, percentage, or valuable consideration, wages or other reward.”.
Amendment of regulation 6
5.  Regulation 6 of the principal Regulations is amended —
(a)by deleting the words “such skills assessment as the Authority may conduct” in paragraph (1) and substituting the words “and completed such course or courses as the Authority may require, and such skills assessment as the Authority may conduct,”;
(b)by inserting, immediately after the word “possesses” in paragraph (1)(a), the words “any one of”;
(c)by deleting the words “such test and skills assessment as the Authority may conduct” in paragraph (2) and substituting the words “and completed such course or courses as the Authority may require, and such test and skills assessment as the Authority may conduct,”;
(d)by deleting sub-paragraph (ii) of paragraph (2)(a) and substituting the following sub-paragraph:
(ii)possesses any one of the qualifications specified in Part II of the Schedule opposite the class he is applying to register or renew registration in;”;
(e)by deleting the comma at the end of paragraph (2)(b)(ii) and substituting a full-stop;
(f)by deleting the words “and he has successfully completed the bridging course referred to in sub-paragraph (a).” in paragraph (2)(b);
(g)by inserting, immediately after paragraph (3), the following paragraph:
(3A)  A person shall be eligible to be registered, or to renew his registration, as a construction supervisor if he has successfully undergone and completed such course or courses as the Authority may require, and where appropriate, such written or oral test as the Authority may conduct, for this purpose and —
(a)he —
(i)possesses —
(A)one of the qualifications specified in Part III of the Schedule opposite the class he is applying to register or renew registration in; or
(B)such other qualifications that, in the opinion of the Authority, are equivalent to those qualifications so specified; and
(ii)has the practical experience that, in the opinion of the Authority, complements those qualifications; or
(b)although not having complied with the requirements of sub-paragraph (a), he satisfies the Authority that he nevertheless has had such practical experience as to render him, in the opinion of the Authority, competent to be registered as a construction supervisor.”; and
(h)by deleting the words “other than waterproofing works” in paragraph (4).
Amendment of regulation 7
6.  Regulation 7 of the principal Regulations is amended by deleting the words “or construction foreman” and substituting the words “, construction foreman or construction supervisor”.
Amendment of regulation 8
7.  Regulation 8(4) of the principal Regulations is amended by deleting the words “or construction foreman in one or more classes referred to in regulation 4 or 5” in sub-paragraph (a) and substituting the words “, construction foreman or construction supervisor in one or more classes referred to in regulation 4, 5 or 5A”.
Amendment of regulation 10
8.  Regulation 10 of the principal Regulations is amended by deleting the words “or construction foreman” wherever they appear in paragraphs (1) and (4) and substituting in each case the words “, construction foreman or construction supervisor”.
Amendment of regulation 11
9.  Regulation 11 of the principal Regulations is amended by deleting paragraph (1) and substituting the following paragraph:
(1)  The fee to register as a construction personnel in each class or to renew such registration shall be —
(a)where the application is made online at the Authority’s website at http://www.bca.gov.sg/coretrade, $10; and
(b)where the application is made in any other manner, $20.”.
Amendment of Schedule
10.  The Schedule to the principal Regulations is amended —
(a)by inserting, immediately after “5” in the Schedule reference, “, 5A”;
(b)by deleting the words “AND CONSTRUCTION FOREMEN” in the Schedule heading and substituting the words “, CONSTRUCTION FOREMEN AND CONSTRUCTION SUPERVISORS”;
(c)by deleting the full-stop at the end of paragraph 1(16) in Part I;
(d)by inserting, immediately after item (16) of paragraph 1 of Part I, the following item:

“ “Certificate”, where not otherwise defined in this paragraph, means a certificate issued by the Building and Construction Authority Academy;”; and
(g)by inserting, immediately after Part II, the following Part:

2.  In this Part —
“BBC” means the Basic Builder Certificate issued by the Authority;
“Certificate”, where not otherwise defined in this paragraph, means a certificate issued by the Building and Construction Authority Academy;
“NBQ” means the National Building Qualification issued by the Building and Construction Authority Academy;
“SEC” means the Skills Evaluation Certificate (Practical) issued by the Authority;
“SEC(K)” means the Skills Evaluation Certificate (written and practical) issued by the Authority;
“Trade Diploma” refers to a trade diploma issued by the Building and Construction Authority Academy.”.
Savings
11.—(1)  Any application for registration made under the principal Regulations before 1st April 2012 that is not dealt with before that date shall be dealt with under the provisions of the principal Regulations as if these Regulations had not been made.
(2)  Any person who is registered as a construction tradesman or construction foreman under the principal Regulations shall be deemed to be registered under the principal Regulations as amended by these Regulations.
