Chapter 276
Road Traffic (Motor Vehicles, Registration and Licensing) (Amendment No. 4) Rules 2003
In exercise of the powers conferred by sections 34 and 140 of the Road Traffic Act, the Minister for Transport hereby makes the following Rules:
Citation and commencement
1.—(1)  These Rules may be cited as the Road Traffic (Motor Vehicles, Registration and Licensing) (Amendment No. 4) Rules 2003 and shall, with the exception of rule 5, be deemed to have come into operation on 4th May 2002.
(2)  Rule 5 shall come into operation on 25th February 2003.
Amendment of rule 7
2.  Rule 7(1) of the Road Traffic (Motor Vehicles, Registration and Licensing) Rules (R 5) (referred to in these Rules as the principal Rules) is amended by deleting the words “, subject to rules 8 and 9,”.
Amendment of rule 8
3.  Rule 8 of the principal Rules is amended by inserting, immediately after paragraph (6), the following paragraph:
(6A)  For the purposes of paragraph (6)(ba), the fee paid under rule 7 in respect of an off-peak car registered with a certificate of entitlement issued on or after 4th May 2002 shall be determined in accordance with the following formula:

A
is the additional registration fee stipulated in Part II of the First Schedule to be payable in respect of the old vehicle under rule 7(1);
 
B
is the quota premium (excluding any applicable rebates) payable under rule 14(1) or (1A) of the Road Traffic (Motor Vehicles, Quota System) Rules (R 31) in respect of the old vehicle; and
 
the value of (17,000 – B) is 0 where B is more than 17,000.
”.
Amendment of rule 9
4.  Rule 9 of the principal Rules is amended —
(a)by deleting sub-paragraph (a) of paragraph (1) and substituting the following sub-paragraph:
(a)the fee payable under rule 7; and”;
(b)by inserting, immediately after the words “off-peak car” in paragraph (3), the words “registered with a certificate of entitlement issued before 4th May 2002””;
(c)by inserting, immediately after paragraph (3), the following paragraph:
(3A)  The Registrar may, in his discretion, grant a rebate, not exceeding $17,000, of the whole or part of —
(a)the additional registration fee; and
(b)the quota premium payable under the Road Traffic (Motor Vehicles, Quota System) Rules (R 31) for a certificate of entitlement,
for an off-peak car registered with a certificate of entitlement issued on or after 4th May 2002.”;
(d)by inserting, at the end of paragraph (4)(b), the word “and”;
(e)by deleting the word “; or” at the end of paragraph (4)(c) and substituting a full-stop; and
(f)by deleting sub-paragraph (d) of paragraph (4).
Amendment of rule 14
5.  Rule 14 of the principal Rules is amended —
(a)by inserting, immediately after paragraph (3), the following paragraph:
(3A)  The Registrar may, in his discretion, allow the particulars of a bid or a bidder to be amended upon payment of a fee of $20.”;
(b)by inserting, immediately after paragraph (8), the following paragraph:
(8A)  Notwithstanding paragraph (8), the Registrar may, in his discretion, refund the fee of $1,000 referred to in that paragraph.”; and
(c)by deleting paragraph (11) and substituting the following paragraph:
(11)  The Registrar may, in his discretion and subject to such conditions as he thinks fit, upon the request of a successful applicant and payment of a fee of $20, assign or transfer to any person the index mark and registration number allotted to the applicant.”.
Amendment of First Schedule
6.  Part VIII of the First Schedule to the principal Rules is amended by deleting items (4) to (7) and substituting the following item:
“(4)
Exceeding 7 years
Nil.”.
