(Certification Marks)
(Amendment) Regulations 2023
In exercise of the powers conferred by section 48 of the Singapore Food Agency Act 2019, the Singapore Food Agency, with the approval of the Minister for Sustainability and the Environment, makes the following Regulations:
Citation and commencement
1.  These Regulations are the Singapore Food Agency (Certification Marks) (Amendment) Regulations 2023 and come into operation on 1 January 2024.
Amendment of regulation 2
2.  In the Singapore Food Agency (Certification Marks) Regulations 2019 (G.N. No. S 282/2019) (called in these Regulations the principal Regulations), in regulation 2 —
(a)in the definition of “certification mark”, replace the full‑stop at the end with a semi‑colon; and
(b)after the definition of “certification mark”, insert —
“ “in‑principle LRP status”, in relation to a laboratory, means a status conferred by the Agency denoting that —
(a)the Agency considers the laboratory’s system is likely to be able to conform to the standard accepted by the Agency for carrying out one or more types of food safety tests; and
(b)the Agency is willing to consider an application for the laboratory to be issued an LRP certificate of recognition;
“Laboratory Recognition Programme” or “LRP” means the programme administered by the Agency to recognise laboratories employing systems that conform to the standard accepted by the Agency for carrying out one or more types of food safety tests;
“LRP certificate of recognition” means a certificate issued by an authorised officer under these Regulations —
(a)attesting that a laboratory employs a system that conforms to the standard accepted by the Agency for carrying out food safety tests; and
(b)authorising the use of a certification mark by the laboratory in relation to the system.”.
Amendment of regulation 3
3.  In the principal Regulations, in regulation 3 —
(a)in paragraph (1)(a), delete “and” at the end;
(b)in paragraph (1)(b), replace the full‑stop at the end with “; and”;
(c)in paragraph (1), after sub‑paragraph (b), insert —
(c)accompanied by any fee that is prescribed under the Interpretation (Singapore Food Agency — Fees) Order 2023 (G.N. No. S 900/2023) for the application.”; and
(d)delete paragraph (3).
Amendment of regulation 4
4.  In the principal Regulations, in regulation 4, after paragraph (2), insert —
(2A)  Despite paragraphs (1) and (2), an authorised officer must not issue an LRP certificate of recognition for a laboratory’s system unless there is an in‑principle LRP status in force for the laboratory.”.
Amendment of regulation 5
5.  In the principal Regulations, in regulation 5(1)(a), delete “or (3)”.
