(Amendment No. 2) Rules 2023

In exercise of the powers conferred by section 10A(4) of the Road Traffic Act 1961, the Minister for Transport makes the following Rules:

Citation and commencement

1. These Rules are the Road Traffic (Motor Vehicles, Quota System) (Amendment No. 2) Rules 2023 and come into operation on 1 January 2024.

Amendment of Third Schedule

2. In the Road Traffic (Motor Vehicles, Quota System) Rules (R 31), in the Third Schedule —

(a)

in paragraph 1(a)(i), delete “or” at the end;

(b)

in paragraph 1(a)(iii), replace the full‑stop at the end with “; or”;

(c)

in paragraph 1(a), after sub‑paragraph (iii), insert —

“(iv)

JPN2023.”;

(d)

in paragraph 1(b)(ii), delete “or” at the end;

(e)

in paragraph 1(b)(iii), replace the full‑stop at the end with a semi‑colon;

(f)

in paragraph 1(b), after sub‑paragraph (iii), insert —

“(iv)	PPNLT 2023; or
(v)	PPNLT 2023 (Alternate).”;

(g)

in paragraph 2, after the definition of “JPN2018”, insert —

“ “JPN2023” means paragraph 1(3) of Article 41 of the Japanese Ministry of Land, Infrastructure and Transport Announcement No. 619 dated 15 July 2002 (ANNOUNCEMENT THAT PRESCRIBES DETAILS OF SAFETY REGULATIONS FOR ROAD VEHICLES), as amended by the Japanese Ministry of Land, Infrastructure, Transport and Tourism Announcement No. 1040 dated 7 October 2022;”; and

(h)

in paragraph 2, after the definition of “PPNLT (Alternate)”, insert —

“ “PPNLT 2023” means the emission standards known as the Post‑Post New Long Term emission regulations that are set out in paragraph 1(5) titled “[JE05‑Mode Mean Value Regulations at Time of Completion Inspection, etc. for Diesel Motor Vehicles (with GVW exceeding 3.5 tons)]” of Article 41 of the Japanese Ministry of Land, Infrastructure and Transport Announcement No. 619 dated 15 July 2002 (ANNOUNCEMENT THAT PRESCRIBES DETAILS OF SAFETY REGULATIONS FOR ROAD VEHICLES), as amended by the Japanese Ministry of Land, Infrastructure, Transport and Tourism Announcement No. 1 dated 4 January 2023;

“PPNLT 2023 (Alternate)” means the emission standards known as the Post‑Post New Long Term emission regulations that are set out in paragraph 1(5) titled “[JE05‑Mode Mean Value Regulations at Time of Completion Inspection, etc. for Diesel Motor Vehicles (with GVW exceeding 3.5 tons)]” of Article 41 of the Japanese Ministry of Land, Infrastructure and Transport Announcement No. 619 dated 15 July 2002 (ANNOUNCEMENT THAT PRESCRIBES DETAILS OF SAFETY REGULATIONS FOR ROAD VEHICLES), as amended by the Japanese Ministry of Land, Infrastructure, Transport and Tourism Announcement No. 1 dated 4 January 2023, with the exhaust emission determined in accordance with the test method set out in the document titled “Measurement Procedure for JE05‑Mode Exhaust Emissions by Means of Chassis Dynamometer” and “Measurement Procedure for WHTC Exhaust Emissions by Means of Chassis Dynamometer”, Kokujikan No. 280 of 16 March 2007 as amended by Kokujikan No. 68 of 1 July 2011 and Kokujikan No. 91 of 30 August 2017, Attachment 2;”.

Amendment of Fourth Schedule

3. In the Road Traffic (Motor Vehicles, Quota System) Rules, in the Fourth Schedule —

(a)

in paragraph 1(a)(i), delete “or” at the end;

(b)

in paragraph 1(a)(iii), replace the full‑stop at the end with “; or”;

(c)

in paragraph 1(a), after sub‑paragraph (iii), insert —

“(iv)

JPN2023.”;

(d)

in paragraph 1(b)(i), delete “or” at the end;

(e)

in paragraph 1(b)(iii), replace the full‑stop at the end with “; or”;

(f)

in paragraph 1(b), after sub‑paragraph (iii), insert —

“(iv)

JPN2023.”; and

(g)

in paragraph 2, after the definition of “JPN2018”, insert —
