(Vehicular Emissions Tax)
(Amendment No. 2) Rules 2023
In exercise of the powers conferred by section 11AA(6) of the Road Traffic Act 1961, the Minister for Transport makes the following Rules:
Citation and commencement
1.  These Rules are the Road Traffic (Vehicular Emissions Tax) (Amendment No. 2) Rules 2023 and come into operation on 1 January 2024.
Amendment of rule 2
2.  In the Road Traffic (Vehicular Emissions Tax) Rules 2017 (G.N. No. S 776/2017) (called in these Rules the principal Rules), in rule 2 —
(a)delete the definitions of “Commission Regulation (EU) No. 2017/1153”, “Euro 6”, “JPN2009” and “UNECE Regulation No. 101”; and
(b)after the definition of “JPN2018”, insert —
“ “JPN2023” means paragraph 1(3) of Article 41 of the Japanese Ministry of Land, Infrastructure and Transport Announcement No. 619 dated 15 July 2002 (ANNOUNCEMENT THAT PRESCRIBES DETAILS OF SAFETY REGULATIONS FOR ROAD VEHICLES), as amended by the Japanese Ministry of Land, Infrastructure, Transport and Tourism Announcement No. 1040 dated 7 October 2022;”.
Amendment of rule 4
3.  In the principal Rules, in rule 4 —
(a)in paragraph (2), replace sub‑paragraph (a) with —
(a)measured in accordance with the provisions of Commission Regulation (EU) No. 2017/1151, UNECE Regulation No. 154 or WLTP Japan; and”;
(b)in paragraph (2A), replace “280 g/km” with “216 g/km”;
(c)in paragraph (3)(a)(i)(A), insert “and” at the end;
(d)in paragraph (3)(a)(i), replace sub‑paragraph (B) with —
(B)for a plug‑in hybrid electric vehicle, measured in accordance with the provisions of Commission Regulation (EU) No. 2017/1151, UNECE Regulation No. 154 or WLTP Japan; and”;
(e)in paragraph (3)(a)(i), delete sub-paragraph (C); and
(f)in paragraph (3), replace sub-paragraph (b) with —
(b)B is the weighted electric energy consumption data that is —
(i)measured in accordance with the provisions of Commission Regulation (EU) No. 2017/1151, UNECE Regulation No. 154 or WLTP Japan; and
(ii)submitted to the Registrar under section 41(1)(a)(ii) of the Energy Conservation Act 2012; and”.
Amendment of rule 5
4.  In the principal Rules, in rule 5(5) —
(a)in sub-paragraph (a), replace “2.0 mg/km” with “1.0 mg/km”; and
(b)in sub-paragraph (b), replace “0.9 mg/km” with “0.85 mg/km”.
Amendment of Second Schedule
5.  In the principal Rules, in the Second Schedule, replace Part 1 with —

For JPN2018 or JPN2023, if NMHC rather than HC is tested, HC to be obtained by dividing the emission result of NMHC by 0.8.
2.Petrol vehicle with engine that does not employ Gasoline Direct Injection technology
(1)Euro 6 (WLTP) for all such emissions; or
(2)JPN2018 or JPN2023 for all such emissions
For JPN2018 or JPN2023, if NMHC rather than HC is tested, HC to be obtained by dividing the emission result of NMHC by 0.8.
3.Diesel vehicles
(1)Euro 6 (WLTP) for all such emissions; or
(2)JPN2018 or JPN2023 for all such emissions
For Euro 6 (WLTP), if “HC + NOx” rather than HC is tested, HC to be obtained by subtracting the emission result of NOx from “HC + NOx”.
For JPN2018 or JPN2023, if NMHC rather than HC is tested, HC to be obtained by dividing the emission result of NMHC by 0.98.
