Insolvency, Restructuring and Dissolution
(Filing, Lodgment and Submission of Documents)
(Amendment) Regulations 2024
In exercise of the powers conferred by section 449 of the Insolvency, Restructuring and Dissolution Act 2018, the Minister for Law makes the following Regulations:
Citation and commencement
1.—(1)  These Regulations are the Insolvency, Restructuring and Dissolution (Filing, Lodgment and Submission of Documents) (Amendment) Regulations 2024 and, except for regulation 3, come into operation on 9 December 2024.
(2)  Regulation 3 is deemed to have come into operation on 31 December 2021.
New regulations 19A and 19B
2.  In the Insolvency, Restructuring and Dissolution (Filing, Lodgment and Submission of Documents) Regulations 2020 (G.N. No. S 586/2020), after regulation 19, insert —
Excluded documents under section 254(3A) of Act
19A.  For the purposes of section 254(3A) of the Act, a document filed or lodged with, or obtained by, the Registrar of Companies on or after 9 December 2024 (other than a form mentioned in regulation 19B) that contains any of the following information about an individual is an excluded document to which section 254(2) and (2A) of the Act does not apply:
(a)the individual’s date of birth;
(b)the individual’s residential address;
(c)the individual’s email address;
(d)the individual’s mobile telephone number.
Prescribed information under section 254(3B)(c) of Act
19B.  For the purposes of section 254(3B)(c) of the Act, the reference to a document in section 254(2) and (2A) of the Act excludes the following entries in a form submitted on the electronic transaction system mentioned in regulation 16(1)(a):
(a)a person’s email address;
(b)an individual’s residential address;
(c)an individual’s mobile telephone number.”.
Miscellaneous amendments
3.  In the Insolvency, Restructuring and Dissolution (Filing, Lodgment and Submission of Documents) Regulations 2020 —
(a)in regulation 16(1)(a), replace “Part VIA of the Accounting and Corporate Regulatory Authority Act (Cap. 2A)” with “Part 6A of the Accounting and Corporate Regulatory Authority Act 2004”; and
(b)in regulation 27(a)(ii), replace “(Cap. 201)” with “1965”.
