(St Luke’s Eldercare Carnival — Exemption)
Order 2019
In exercise of the powers conferred by section 66 of the Active Mobility Act 2017, the Minister for Transport makes the following Order:
Citation
1.  This Order is the Active Mobility (St Luke’s Eldercare Carnival — Exemption) Order 2019.
Definitions
2.  In this Order —
“CWA Singapore” means the company incorporated under the Companies Act (Cap. 50) as Cycling Without Age Singapore Ltd. (UEN 201714757N);
“specified e‑trishaw” means a three‑wheeled pedal cycle that —
(a)is constructed or adapted for the carriage of passengers;
(b)is equipped with an electric motor;
(c)may be propelled by human power or by the electric motor with which it is equipped, or by both; and
(d)is used by CWA Singapore for the purpose of St Luke’s Eldercare Carnival;
“St Luke’s Eldercare Carnival” means the event known as St Luke’s Eldercare Carnival conducted on 23 November 2019 from 9 a.m. to 7 p.m.
Exemption for driver of specified e‑trishaw
3.  Section 16(1)(b) of the Act does not apply to an individual who drives a specified e‑trishaw on any part of the footpaths located on or in the vicinity of the blue‑coloured lines that are delineated in the map set out in the Schedule under the following conditions:
(a)the individual has completed a training course conducted by CWA Singapore on how to drive the specified e‑trishaw;
(b)the individual is authorised by CWA Singapore to drive the specified e‑trishaw;
(c)the specified e‑trishaw is driven only during and in connection with St Luke’s Eldercare Carnival;
(d)the individual who drives the specified e‑trishaw —
(i)does not drive at a speed exceeding 10 km/h;
(ii)gives way to other users of the footpaths;
(iii)drives with all passengers on the specified e‑trishaw safely secured; and
(iv)keeps a distance of at least 100 metres in front of or behind any other specified e‑trishaw;
(e)the specified e‑trishaw is accompanied by a safety marshal who ensures the safe use of the specified e‑trishaw;
(f)the specified e‑trishaw is only used to carry, for their leisure, passengers who are elderly, unable to walk or have difficulty in walking;
(g)the specified e‑trishaw is not used to carry passengers for hire or reward;
(h)the specified e‑trishaw does not carry, at any time, more than 2 passengers;
(i)there are no more than 4 other specified e‑trishaws being driven on the footpaths when the specified e‑trishaw is driven;
(j)there is in force, during St Luke’s Eldercare Carnival at which the specified e‑trishaw is driven, a policy of insurance in relation to the specified e‑trishaw insuring against any liability in respect of the death of or bodily injury sustained by any person (other than the driver or any passenger of the specified e‑trishaw), or property damage suffered by any person (other than the driver or any passenger of the specified e‑trishaw), caused by or arising out of the use of the specified e‑trishaw.
