Control of Essential Supplies (Petroleum) Regulations

Citation
1.  These Regulations may be cited as the Control of Essential Supplies (Petroleum) Regulations.
Definitions
2.  In these Regulations, unless the context otherwise requires —
“authorised officer” means an officer authorised by the Controller to act on his behalf;
“filling station” means any premises or place used or intended to be used by way of trade or for gain for fuelling of motor vehicles with petroleum by means of a pump or stand pipe or other like connection with such premises or place.
Petroleum not to be sold at filling stations at price exceeding that determined by Controller
3.  No person shall supply or sell any petroleum at a filling station at any price exceeding the maximum price for that type or grade as may from time to time be determined by the Controller unless the Controller has determined that there shall not for any period of time be any maximum price for that type or grade of petroleum1

Withholding or concealing petroleum from sale
4.  No person shall conceal any petroleum, or do any act, in order to withhold petroleum from sale at a filling station.
No purchase of petroleum exceeding 5 litres
5.  No person shall without the consent of the Controller purchase or obtain any quantity of petroleum exceeding 5 litres from a filling station for any purpose except for the propulsion of a vehicle.
Quantity to be specified by Controller
6.  No person shall purchase or obtain any quantity of petroleum from a filling station in excess of the quantity specified by the Controller from time to time.
No unauthorised removal of petroleum from vehicle
7.  No person shall without reasonable excuse siphon off or by any other means take out or remove any petroleum from the supply tank of a vehicle.
Petroleum to be used only for specific purposes
8.  No person shall use or permit the use of any petroleum purchased or obtained from a filling station for any purpose other than for the purpose in respect of which the petroleum is sold or acquired.
Supplier to provide information to Controller
9.  The Controller may require any person who sells or supplies any petroleum to a filling station to furnish him with such information as he may require from time to time relating to the sales of petroleum made by him and the stocks of petroleum held by him.
Controller to control supply and may authorise redistribution
10.  The Controller may at any time by notice in writing direct any person to stop or reduce the supplies of petroleum to any filling station and may require such supplies so withheld to be distributed to other filling stations.
Powers of Controller and authorised officers
11.  For the purposes of these Regulations, the Controller and any authorised officer may —
(a)arrest without warrant any person who he has reasonable cause to believe has committed an offence under these Regulations and take such person before a Magistrate's Court or police station to be dealt with in accordance with the provisions of the Criminal Procedure Code [Cap. 68];
(b)enter and inspect by day or night any filling station or any part thereof; and
(c)require, by a notice in writing, the attendance before himself of any person, being within the limits of Singapore, who, from information given or otherwise, may be able to give any information relating to the commission of an offence under these Regulations.
Offences
12.  Any person who —
(a)obstructs or wilfully delays the Controller or an authorised officer in the exercise of his duties and functions under these Regulations;
(b)fails to comply with any direction or notice given or requisition made by the Controller or an authorised officer in pursuance of these Regulations;
(c)fails to produce any records or documents which may be required by the Controller or an authorised officer;
(d)refuses without reasonable cause to appear before the Controller or an authorised officer; or
(e)gives any information which is false or misleading to the Controller or an authorised officer,
shall be guilty of an offence under these Regulations.
Other offences
13.  Any person who contravenes regulation 3, 4, 5, 6, 7 or 8 shall be guilty of an offence under these Regulations.
Penalty
14.  Any person who is guilty of an offence under these Regulations shall be liable on conviction to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 6 months or to both.
Compounding of offences
15.  The Controller may compound any offence under these Regulations by accepting from the person reasonably suspected of having committed the offence a sum of money not exceeding $500.
