Environmental Public Health
(General Waste Disposal Facility —
Exemption) Regulations 2017
In exercise of the powers conferred by sections 110 and 111 of the Environmental Public Health Act, the National Environment Agency, with the approval of the Minister for the Environment and Water Resources, makes the following Regulations:
Citation and commencement
1.  These Regulations are the Environmental Public Health (General Waste Disposal Facility — Exemption) Regulations 2017 and come into operation on 1 August 2017.
Definitions
2.  In these Regulations, unless the context otherwise requires —
“design capacity” means the amount of general waste (measured in tonnes per day) which a general waste disposal facility is designed to receive and process;
“general waste” has the same meaning as in regulation 2(1) of the Environmental Public Health (General Waste Collection) Regulations (Rg 12);
“general waste disposal facility” has the same meaning as in regulation 2 of the Environmental Public Health (General Waste Disposal Facility) Regulations 2017 (G.N. No. S 380/2017).
Exemption
3.—(1)  A person constructing, establishing, maintaining or operating any general waste disposal facility specified in the Schedule is exempted from section 23(1) of the Act.
(2)  The exemption under paragraph (1) of a person constructing, establishing, maintaining or operating a general waste disposal facility specified in paragraph 1 of the Schedule is subject to the condition that the person must make a declaration to the Director‑General, once every 2 years and in such form and manner as the Director‑General requires, that the facility has a design capacity of below 5 tonnes of general waste per day.
