Citation

1. This Notification may be cited as the Factories (Qualifications and Training of Safety Officers) Notification.

Safety officer to be registered

2. No person may act as a safety officer in a factory unless he is registered under this Notification and possesses a valid certificate of registration.

Application for registration

3. A person who wishes to be registered as a safety officer in a factory must apply to the Chief Inspector in the form set out in the Schedule.

Persons who may be registered

4. A person may be registered as a safety officer if he is 21 years of age or above and —

(a)

(i)

has obtained from an approved educational institution —

(A)	a degree in engineering, physics, chemistry, bio-chemistry, ergonomics, occupational safety, occupational health or occupational hygiene; or
(B)	a professional diploma in engineering,

which is acceptable to the Chief Inspector;

(ii)

has successfully completed a training course for safety officers approved by the Chief Inspector; and

(iii)

has at least 2 years’ practical experience relevant to the work to be performed by a safety officer;

(b)

(i)

has obtained from an approved educational institution —

(A)	a diploma in ergonomics, occupational safety, occupational health or occupational hygiene; or
(B)	a technician diploma in engineering,

which is acceptable to the Chief Inspector;

(ii)

has successfully completed a training course for safety officers approved by the Chief Inspector; and

(iii)

has at least 3 years’ practical experience relevant to the work to be performed by a safety officer;

(c)

was registered as a safety officer under the cancelled Factories (Qualifications and Training of Safety Officers) Notification and his registration has not been cancelled by the Chief Inspector; or

(d)

satisfies the Chief Inspector that he has such qualifications and practical experience as to be suitable for registration as a safety officer.

Power of Chief Inspector to refuse registration

5. If the Chief Inspector is not satisfied that an applicant should be registered as a safety officer, the Chief Inspector may refuse to register the applicant.

Certificates of registration

6.—(1) If the Chief Inspector is satisfied that an applicant may be registered as a safety officer, the Chief Inspector shall register the applicant by issuing him a certificate of registration on payment of the registration fee.

(2) A certificate of registration, unless otherwise stated in the certificate or cancelled pursuant to this Notification or to the Factories (Registration and Duties of Safety Officers) Regulations, is valid for a period of 2 years from the date of issue.

(3) The Chief Inspector may on payment of the renewal fee renew a certificate of registration.

Safety officer to attend courses

7.—(1) The Chief Inspector may require a safety officer to attend training courses which, in the opinion of the Chief Inspector, are relevant to the work of a safety officer.

(2) Where a safety officer fails to comply with sub-paragraph (1), the Chief Inspector may cancel the registration of the safety officer.

(3) The safety officer whose registration is cancelled under sub-paragraph (2) must surrender his certificate of registration to the Chief Inspector within such period as the Chief Inspector may specify.

Appeal

8. A person who is aggrieved by a decision of the Chief Inspector under this Notification may, within 2 weeks from the date of the decision, appeal to the Minister whose decision shall be final.

Saving

9. Certificates of registration issued under the cancelled Factories (Qualifications and Training of Safety Officers) Notification and are valid immediately before 1st December 1995 shall, unless earlier cancelled pursuant to this Notification or to the Factories (Registration and Duties of Safety Officers) Regulations, continue to be valid for one year after that date.
