Factories (Safety Officers) Order1

Citation
1.  This Order may be cited as the Factories (Safety Officers) Order.
Definitions
2.  In this Order, unless the context otherwise requires —
“contract sum” means the value of the works to be carried out by contractors undertaking building operations or works of engineering construction as stated in the contract;
“full-time safety officer” means a safety officer who is employed under a contract of service to work in a factory and who spends at least 40 hours per week exclusively on safety supervision and on promoting the safe conduct of work within the factory;
“part-time safety officer” means a safety officer who is —
(a)employed under a contract of service to work in a shipyard and who spends at least 40 hours per week in the shipyard out of which 15 hours per week shall be exclusively devoted to safety supervision and on promoting the safe conduct of work within the shipyard; or
(b)employed under a contract for services or a contract of service to work in any other factory and who spends at least 15 hours per week exclusively on safety supervision and on promoting the safe conduct of work within the factory;
“safety officer” means a person who is registered as a safety officer under paragraph 3 of the Factories (Qualifications and Training of Safety Officers) Notification.

Factories to employ full-time safety officer
3.  The occupier of any of the following classes or description of factories shall employ a full-time safety officer in the factory:
(a)shipyards in which any ships, tankers and other vessels are constructed, reconstructed, repaired, refitted, finished or broken up, and in which 100 or more persons are employed;
(b)factories which are used for manufacturing, processing, seasoning, or preserving timber or timber products, and in which 100 or more persons are employed;
(c)factories used for processing petroleum or petroleum products;
(d)factories in which building operations or works of engineering construction of a contract sum of $50 million or more are carried out; and
(e)other factories in which 500 or more persons are employed, except those which are used for manufacturing garments.
Factories to employ part-time safety officer
4.  The occupier of any of the following classes or descriptions of factories shall employ a part-time safety officer in the factory:
(a)shipyards in which any ships, tankers and other vessels are constructed, reconstructed, repaired, refitted, finished or broken up, and in which less than 100 persons are employed;
(b)factories which are used for manufacturing garments and in which 500 or more persons are employed;
(c)factories in which building operations or works of engineering construction of a contract sum of $10 million or more but less than $50 million are carried out; and
(d)factories not mentioned in paragraph 3 or in sub-paragraph (a), (b) or (c) and in which 100 or more but less than 500 persons are employed.
Transitional
5.—(1)  Notwithstanding the revocation of the Factories (Safety Officers) Order, the occupier of any factory in which 500 or more persons are employed, except those which are used for manufacturing garments or electronic appliances or in which only building operations or works of engineering construction are being carried out, shall continue to employ a full-time safety officer until 30th June 1996.

(2)  Notwithstanding the revocation of the Factories (Safety Officers) Order, the occupier of any factory —
(a)which is used for the manufacture of electronic appliances and in which 500 or more persons are employed; or
(b)not mentioned in sub-paragraph (a) or (1) and in which 100 or more persons but not more than 500 persons are employed, except those in which only building operations or works of engineering construction are being carried out,
shall continue to employ a part-time safety officer until 30th June 1996.
(3)  Nothing in sub-paragraphs (1) and (2) shall require the occupier of a factory who is required to employ a safety officer under paragraph 3 or 4 to employ more than one safety officer in respect of that factory.
