Citation
1.  These Regulations may be cited as the Human Organ Transplant Regulations.
Conditions for diagnosis of irreversible cessation of all brain functions
2.  The conditions for considering diagnosis of irreversible cessation of all functions of the brain of a person shall be —
(a)there should be no doubt that the patient’s condition is due to irremediable structural brain damage. The diagnosis of a disorder which can lead to the irreversible cessation of all functions of the brain should have been fully established;
(b)there should be no suspicion that the patient’s condition is due to depressant drugs, hypothermia or metabolic and endocrine factors; and
(c)the patient’s cessation of spontaneous respiration is not caused by neuromuscular blocking agents or other drugs.
Criteria for determining irreversible cessation of all brain functions
3.  The criteria for determining the irreversible cessation of all functions of the brain of a person shall be that —
(a)the pupils are fixed and non-reactive to strong light;
(b)there is no corneal reflex;
(c)there is no spontaneous motor response to painful stimulus, excluding spinal reflexes;
(d)there is no oculocephalic reflex;
(e)there is no gag reflex or reflex response to tracheo-bronchial stimulation;
(f)there is no vestibulo-ocular response on instillation of 50 cubic centimetres of ice-cold water into each ear; and
(g)there is no spontaneous respiration even with carbon dioxide tension at 50 millimetres or more of mercury.
Qualifications required for certification under section 5
4.  The postgraduate medical qualification recognised by the Director as a qualification entitling a medical practitioner to certify death of a person under section 5(3)(c) of the Act shall be —
(a)Master of Medicine (Surgery) (Singapore);
(b)Master of Medicine (Internal Medicine) (Singapore);
(c)Master of Medicine (Anaesthesia) (Singapore);
(d)Master of Medicine (Paediatrics) (Singapore); or
(e)any other equivalent postgraduate qualification awarded by any other university or college which is recognised by the Medical Council established under section 3(1) of the Medical Registration Act [Cap. 174].
Forms
5.  The forms for —
(a)authorising the removal of any organ from the body of a person under section 5(1) of the Act shall be in the Form A set out in the Schedule;
(b)certifying the death of a person under section 5(3) of the Act shall be in the Form B set out in the Schedule;
(c)the objection to removal of any organ under section 9(1) of the Act shall be in the Form C set out in the Schedule;
(d)the acknowledgment of receipt of the objection to removal of any organ shall be in the Form D set out in the Schedule;
(e)withdrawal of the objection registered under section 9(1) of the Act shall be in the Form E set out in the Schedule; and
(f)the acknowledgment of the withdrawal of the objection registered under section 9(1) of the Act shall be in the Form F set out in the Schedule.
