(Chapter 122D)
Health Products (Medical Devices) (Exemption) Order 2010
In exercise of the powers conferred by section 70 of the Health Products Act, the Health Sciences Authority hereby makes the following Order:
Citation and commencement
1.  This Order may be cited as the Health Products (Medical Devices) (Exemption) Order 2010 and shall come into operation on 10th August 2010.
Definition
2.  In this Order, “medical device” means a medical device referred to in the First Schedule to the Act.
Exemption
3.—(1)  Sections 13, 14 and 15 of the Act shall not apply to any medical device that is imported, supplied, used or administered for the purpose of a clinical trial in accordance with the Medicines (Clinical Trials) Regulations (Cap. 176, Rg 3).
(2)  Sections 13 and 14 of the Act shall not apply to the import or supply by wholesale of any medical device in respect of which a licence to deal with the medical device has been granted under the Radiation Protection Act (Cap. 262).
