Infectious Diseases (Notification of Infectious Diseases) (Exemption) Order 2006
In exercise of the powers conferred by section 71 of the Infectious Diseases Act, the Minister for Health hereby makes the following Order:
Citation and commencement
1.  This Order may be cited as the Infectious Diseases (Notification of Infectious Diseases) (Exemption) Order 2006 and shall be deemed to have come into operation on 1st June 2006.
Exemption
2.—(1)  Subject to sub-paragraph (2), section 6 of the Act shall not apply to any registered medical practitioner practising in, or any employee of, any of the medical clinics set out in the Schedule in relation to the administration of an anonymous test on any person for Human Immunodeficiency Virus Infection (Non-Acquired Immune Deficiency Syndrome).
(2)  Nothing in sub-paragraph (1) shall be construed as exempting any registered medical practitioner or employee referred to in that sub-paragraph from the duty under section 6 of the Act to notify the Director if a person on whom an anonymous test is administered is found to be suffering from, or to be a carrier of, any infectious disease other than Human Immunodeficiency Virus Infection (Non-Acquired Immune Deficiency Syndrome).
(3)  In this paragraph, “anonymous test” means a test for the purpose of sub-paragraph (1) where no identifying information is asked of the person seeking the test.
