Development Authority (Saving and
Transitional Provisions) Regulations 2016
In exercise of the powers conferred by section 92(3) of the Info-communications Media Development Authority Act 2016, the Minister for Communications and Information makes the following Regulations:
Citation and commencement
1.  These Regulations are the Info-communications Media Development Authority (Saving and Transitional Provisions) Regulations 2016 and come into operation on 1 October 2016.
Definitions
2.  In these Regulations, unless the context otherwise requires —
“appointed date” means 1 October 2016;
“Former IDA” has the same meaning as in section 87 of the IMDA Act;
“Former MDA” has the same meaning as in section 87 of the IMDA Act;
“IMDA Act” means the Info-communications Media Development Authority Act 2016 (Act 22 of 2016);
“principal Act” means any Act (except a repealed Act) that, immediately before the appointed date, authorised the Former IDA (or any of its employees) or the Former MDA (or any of its employees) to perform any function under that Act;
“repealed Act” means the Info-communications Development Authority of Singapore Act (Cap. 137A) or the Media Development Authority of Singapore Act (Cap. 172);
“Section 16 Notification” means the Media Development Authority of Singapore (Regulated Persons) Notification 2003 (G.N. No. S 176/2003) made by the Minister under section 16(3) of the Media Development Authority of Singapore Act in force immediately before the appointed date;
“Section 21 Notification” means the Media Development Authority of Singapore (Regulated Persons) (Dominant and Non‑dominant Positions) Notification 2003 (G.N. No. S 180/2003) made by the Former MDA under section 21(4) of the Media Development Authority of Singapore Act in force immediately before the appointed day;
“transferred IDA employee” means an employee of the Former IDA who is transferred to the Authority on the appointed date under section 84(1) of the IMDA Act;
“transferred IDA function” means any function discharged by the Info-communications Media Development Authority Designate Wing of the Info-communications Authority of Singapore on the eve of the appointed date;
“transferred MDA employee” means an employee of the Former MDA who is transferred to the Authority on the appointed date under section 84(1) of the IMDA Act.
Section 16 Notification
3.—(1)  The Section 16 Notification remains in force and is deemed to have been made by the Minister under the definition of “regulated person” in section 2 of the IMDA Act.
(2)  The references to section 16(3)(a)(i) and (ii) of the Media Development Authority of Singapore Act in the Schedule to the Section 16 Notification are to be taken as references to paragraph (b) of the definition of “regulated person” in section 2 of the IMDA Act.
(3)  The references to section 16(3)(b) of the Media Development Authority of Singapore Act in the Schedule to the Section 16 Notification are to be taken as references to paragraph (a) of the definition of “regulated person” in section 2 of the IMDA Act.
Section 21 Notification
4.—(1)  The Section 21 Notification remains in force and is deemed to have been made by the Authority under section 63(3)(b) of the IMDA Act.
(2)  The reference to section 21 of the Media Development Authority of Singapore Act in paragraph 2 of the Section 21(4) Notification is to be taken as a reference to section 63 of the IMDA Act.
(3)  The reference to section 16(3) of the Media Development Authority of Singapore Act in paragraph 2(b) of the Section 21(4) Notification is to be taken as a reference to the definition of “regulated person” in section 2 of the IMDA Act.
Appointment of transferred MDA employee under principal Act
5.—(1)  This regulation applies to a transferred MDA employee who, immediately before the appointed date, holds any appointment under a principal Act.
(2)  The transferred MDA employee’s appointment under the principal Act continues until —
(a)the appointment is revoked under that Act;
(b)the term of the appointment expires; or
(c)the employee vacates his or her office, for any reason, before the expiry of the term of the appointment.
Appointment of transferred IDA employee under principal Act
6.—(1)  This regulation applies to a transferred IDA employee —
(a)who, immediately before the appointed date, holds any appointment under a principal Act; and
(b)whose function under that Act is a transferred IDA function.
(2)  The transferred IDA employee’s appointment under the principal Act continues until —
(a)the appointment is revoked under that Act;
(b)the term of the appointment expires; or
(c)the employee vacates his or her office, for any reason, before the expiry of the term of the appointment.
