(Protected Areas and Protected Places)
(Photography) (Exemption) Order 2018
In exercise of the powers conferred by section 82 of the Infrastructure Protection Act 2017, the Minister for Home Affairs makes the following Order:
Citation and commencement
1.  This Order is the Infrastructure Protection (Protected Areas and Protected Places) (Photography) (Exemption) Order 2018 and comes into operation on 18 December 2018.
Definitions
2.  In this Order, unless the context otherwise requires —
“air navigation permit” means a UA operator permit or an activity permit specified in paragraph 72F of the Air Navigation Order (Cap. 6, O 2);
“authorised trial” means the trial of automated vehicle technology or an autonomous motor vehicle on a road under an authorisation granted under rule 7(1)(a)(i) of the Road Traffic (Autonomous Motor Vehicles) Rules 2017 (G.N. No. S 464/2017);
“automated vehicle technology” and “autonomous motor vehicle” have the meanings given by section 2(1) of the Road Traffic Act (Cap. 276);
“competent security officer” has the meaning given by section 2(1) of the Air Navigation Act (Cap. 6).
Exemption for authorised trials and unmanned aircrafts
3.—(1)  Section 29(1) of the Act does not apply to a person taking a photograph of a protected area or a protected place during an authorised trial using any equipment of the autonomous motor vehicle or automated vehicle technology used in the trial.
(2)  Sections 29(1) and 30(4) of the Act do not apply to a person taking a photograph of a protected area or a protected place using any equipment on board an unmanned aircraft while the unmanned aircraft is in flight if —
(a)the unmanned aircraft is operated at that time under the authority of and in accordance with the relevant air navigation permit or air navigation permits required for that unmanned aircraft in paragraph 72F of the Air Navigation Order; or
(b)the photograph is taken in accordance with a permit given by a competent security officer.
(3)  Where the person mentioned in sub‑paragraph (2) is not the operator of the unmanned aircraft mentioned in that sub‑paragraph, section 30(4) of the Act does not also apply to the operator of that unmanned aircraft if sub-paragraph (2)(a) or (b) is satisfied.

Exemption for specified officers
4.—(1)  Section 29(1) of the Act does not apply to or in relation to a specified officer who takes a photograph of a protected area or a protected place if —
(a)the specified officer takes the photograph to perform or discharge the specified officer’s duty; and
(b)where the photograph is taken using a device or equipment — that device or equipment is registered with, or issued by, a Home Team agency or the HTX.
(2)  In this paragraph —
“Home Team agency” means any department of the Government within the Ministry of Home Affairs;
“HTX” means the Home Team Science and Technology Agency established by section 3 of the Home Team Science and Technology Agency Act 2019;
“specified officer” means —
(a)an officer of the Central Narcotics Bureau appointed under section 3 of the Misuse of Drugs Act 1973;
(b)an immigration officer of the Immigration & Checkpoints Authority appointed under section 3 of the Immigration Act 1959;
(c)an officer or employee of, or a person seconded to, the HTX;
(d)a police officer, a special police officer, a forensic specialist or an intelligence officer, within the meaning given by the Police Force Act 2004;
(e)an officer of the Singapore Civil Defence Force raised and maintained in accordance with the Civil Defence Act 1986; or
(f)a prison officer of the Singapore Prison Service who is appointed under section 20 of the Prisons Act 1933.
