Massage Establishments Act
(Chapter 173)
Massage Establishments (Exemption) Order 2006
In exercise of the powers conferred by section 11 of the Massage Establishments Act, the Minister for Home Affairs hereby makes the following Order:
Citation and commencement
1.  This Order may be cited as the Massage Establishments (Exemption) Order 2006 and shall come into operation on 26th June 2006.
Exemption
2.—(1)  Subject to sub-paragraph (2), the Minister hereby exempts from the provisions of the Act premises which are an establishment for massage as defined in the Act merely by reason of any or all of the following forms of massage being administered in full view of the public:
(a)foot-reflexology;
(b)physiotherapy;
(c)traditional massage;
(d)curative massage.
(2)  Premises which are an establishment for massage and which are referred to in sub-paragraph (1) are exempted from the provisions of the Act only if the following requirements are satisfied:
(a)there is no room, partition, cubicle or any form of separation device that allows massage services to be administered in private and outside the view of other customers in the premises;
(b)any area in the premises where massage services are carried out is clearly visible from outside the premises and any window in the premises or entrance to the premises is not obscured with any device or accessory such as tinted glass panel, curtain, blinds or any poster or notice;
(c)only citizens and permanent residents of Singapore and Malaysians with valid work permits are employed in the establishment for massage;
(d)no employee of the establishment for massage is indecently dressed when discharging his duties thereat;
(e)the employees of the establishment for massage do not tout for business or loiter outside the premises of the establishment; and
(f)the operator of the establishment for massage registers details of the operations of the establishment with the Licensing Officer and complies with the requirements set out in the Schedule.
(3)  The Licensing Officer may, by notice in writing addressed to the operator of an establishment for massage carried on in any premises exempted under this Order, revoke the exemption if the Licensing Officer —
(a)is satisfied that the operator is not a suitable person to be allowed to carry on the business of the establishment for massage on exempted premises; or
(b)considers it in the public interest to revoke the exemption.
Revocation
3.  The Massage Establishments (Exemption) Order (O 1) is revoked.
