Citation
1.  These Regulations may be cited as the National Council of Social Service Regulations.
PART I
MEMBERSHIP OF COUNCIL
Conditions for membership of Council
2.—(1)  Any organisation which —
(a)is registered under the Business Registration Act [Cap. 32] or the Societies Act [Cap. 311] or incorporated under the Companies Act [Cap. 50] or established by or under any written law; and
(b)has been carrying on business for a continuous period of at least two years,
may apply to be either a full or associate member of the Council where it satisfies the requirements of section 15(2) or (3) of the Act, as the case may be.
(2)  The Council may, in its discretion, and subject to such condition as it may impose, waive all or any of the requirements under paragraph (1)(b)
(3)  The council may, in its discretion, without assigning any reason, refuse to grant membership under section 15(2) or (3) of the Act to any organisation.
Application for membership of Council
3.—(1)  An application for full or associate membership of the Council under section 15 of the Act shall be made to the Council in such form as may be provided by the Board.
(2)  The Board shall consider every duly completed application and communicate its decision in writing to the applicant within 3 months from the receipt of the application.
Membership fee
4.—(1)  Every full and associate member of the Council shall pay such membership fee as may be determined by the Council.
(2)  The membership fee shall be payable on becoming a member of the Council and thereafter annually on 1st April of each year.
(3)  An applicant who becomes a member of the Council on or after 30th September in any year shall pay only one-half of the membership fee for that year.
(4)  Any member who fails or neglects to pay the membership fee, or any part thereof, within 3 months after it has become due or payable, shall cease to be a member of the Council, but may be reinstated on payment of all arrears.
(5)  The membership fee shall not be refunded unless, in the opinion of the Board, there is good and sufficient reason to do so.
(6)  The Board may, in its discretion, waive the whole or any part of the membership fee due and payable by any member of the Council.
Obligations of full members of Council
5.  Every full member of the Council shall —
(a)submit a certified copy of its annual report, audited accounts and balance-sheet to the Board within 3 months from the end of its financial year;
(b)furnish to the Board with such information with respect to its functions in such manner and at such times as the Board may require; and
(c)comply with such guidelines with respect to standards of social service as may from time to time be issued by the Council.
Resignation from membership of Council
6.  Any member of the Council may at any time resign from the membership of the Council by giving 3 months’ notice in writing to the Board; but any member giving such notice after 1st April in any year shall be liable to pay the membership fee for the year.
Termination of membership of Council
7.—(1)  The Board may terminate the membership of a member of the Council where —
(a)the full or associate member ceases to satisfy the requirements of section 15(2) or (3) of the Act;
(b)the full or associate member ceases to be registered under the Business Registration Act [Cap. 32] or the Societies Act [Cap. 311] or is wound up under the Companies Act [Cap. 50];
(c)the full member fails or neglects to comply with regulation 5(a) or (b) or any of the guidelines issued under regulation 5(c); or
(d)the member has, in the opinion of the Board, conducted itself in a manner prejudicial to the good name or interests of the Council.
(2)  If the Board proposes to terminate the membership of any member of the Council, the Board shall give to the member notice in writing of the proposal.
(3)  A notice given under paragraph (2) shall state that, within 21 days of the service thereof, the member may make representations in writing to the Board and the Board shall not determine the matter without considering any representations received within that period of 21 days.
(4)  If the Board terminates the membership of a member under this regulation, it shall give to the member notice in writing of the termination.
