Public Transport Council Act

Public Transport Council (Bus Service Licence) Regulations 2006
In exercise of the powers conferred by section 28 of the Public Transport Council Act, the Public Transport Council, with the approval of the Minister for Transport, hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Public Transport Council (Bus Service Licence) Regulations 2006 and shall come into operation on 29th December 2006.
Definitions
2.  In these Regulations, unless the context otherwise requires —
“basic bus service” means a bus service, other than a temporary bus service, which is required to charge the fares as approved by the Public Transport Council and published in the Gazette;
“licensee” means the holder of a bus service licence granted under section 12 of the Act;
“non-basic bus service” means a bus service, other than a temporary bus service or a basic bus service;
“operating schedule” means the schedule attached to a bus service licence containing a description of the bus service to be provided by the licensee, as may be approved by the Council from time to time;
“temporary bus service” means a bus service which operates for a continuous period of not more than 6 months.
Application for bus service licence
3.—(1)  An application for the grant of a bus service licence to operate a basic bus service, a non-basic bus service or a temporary bus service shall be made in such form as the Council may require.
(2)  An application for the renewal of a bus service licence to operate a basic bus service or a non-basic bus service shall be made in such form as the Council may require no later than 2 months before the expiry of the licence.
Duration of bus service licence
4.—(1)  A bus service licence to operate a basic bus service or a non-basic bus service shall be valid for a period specified by the Council which shall not exceed 2 years or such period as the Council may determine.
(2)  A bus service licence to operate a temporary bus service shall be valid for a period specified by the Council which shall not exceed 6 months.
Amendment of operating schedule
5.  An application to amend the operating schedule shall be made in such form as the Council may require.
Fees
6.—(1)  The fees payable for —
(a)the grant of a bus service licence to operate a basic bus service, a non-basic bus service or a temporary bus service;
(b)the renewal of a bus service licence to operate a basic bus service or a non-basic bus service; and
(c)the grant of approval to amend an operating schedule,
shall be as specified in the Schedule.
(2)  The Council may, as it thinks fit, waive or refund the whole or any part of the fee payable under these Regulations.
Late interest rate
7.—(1)  All fees, contributions, financial penalties or other sums payable under Part IV of the Act shall be paid by such date as may be specified by the Council to the licensee.
(2)  For the purposes of section 26A of the Act, where any fee, contribution, financial penalty or other sum payable under Part IV of the Act remains due and unpaid by a licensee, the licensee shall pay interest at an annual rate of 2% above the average of the prevailing annual prime lending rate of such bank or banks in Singapore as the Council may determine.
(3)  The interest referred to in paragraph (2) shall be levied from the date the payment is due up to and including the date the payment is made.
Revocation
8.  The Public Transport Council Licensing Regulations (Rg 1) are revoked.
