Public Utilities (Central Water Catchment Area and Catchment Area Parks) Regulations

Citation
1.  These Regulations may be cited as the Public Utilities (Central Water Catchment Area and Catchment Area Parks) Regulations.
Definitions
2.  In these Regulations, unless the context otherwise requires —
“authorised officer” means an officer of the Board or any public officer authorised in that behalf by the Board;
“Catchment Area Park” means any area described in the First Schedule;
“Central Water Catchment Area” means any area described in the Second Schedule;
“live bait” means any organic matter such as fish, frog, and raw meat of animal or marine origin;
“stream” means earth stream, canal, drain or any water course in any Catchment Area Park or the Central Water Catchment Area;
“vehicle” means any vehicle whether mechanically propelled or otherwise.
Board to decide on opening and closing hours
3.  The Board may open or close a Catchment Area Park or any part thereof to the public at or between such hours as may be specified by the Board in notices exhibited thereat or as may be made known to the public by the Board in any other manner.
Vehicle in Catchment Area Park
4.—(1)  No person shall drive a lorry exceeding a gross weight of 3 tonnes in a Catchment Area Park except with the permission of the authorised officer.
(2)  No person shall drive or ride a vehicle in or out of a Catchment Area Park except through an authorised entrance or exit.
(3)  No person shall drive or ride a vehicle within a Catchment Area Park except on such roads as are indicated by traffic or other signs to be open for use by vehicles.
(4)  Notwithstanding paragraph (3), invalid chairs and perambulators may be used on any road or footpath in any part of a Catchment Area Park.
(5)  No person shall drive or ride a vehicle with speed exceeding 25 kilometres per hour within a Catchment Area Park.
Vehicle in Central Water Catchment Area
5.—(1)  No person shall bring any vehicle into or cause any vehicle to be brought into the Central Water Catchment Area unless prior consent in writing of the Board or the authorised officer is obtained.
(2)  Any person driving or riding a vehicle that has been allowed entry into the Central Water Catchment Area shall drive or ride the vehicle only on such roads as are indicated by traffic or other signs to be open for use by vehicles.
(3)  Paragraph (1) shall not apply to areas which are Catchment Area Parks, public roads and lands permitted by the Board to be used by any person for any specified approved purposes including golf courses.
Prohibited activities in Catchment Area Park
6.  No person in a Catchment Area Park shall —
(a)damage any plant, shrub or tree or any part of the same, or damage any flower bed, or do any act which causes damage to the flora;
(b)kill, hunt, shoot or trap any animal or do any act which causes injury to the fauna;
(c)bathe or wash himself or any other person, animal or thing in any reservoir or stream or pollute any reservoir or stream in any manner;
(d)spit, urinate or defecate in any part of the grounds of the Catchment Area Park (including into any reservoir or stream therein) except in the appropriate toilet facilities provided for the purpose;
(e)have with him —
(i)any dog which is not on a leash and under proper control; or
(ii)any other animal which is not under proper control;
(f)release any animal into the reservoir or allow any animal to stray into any part of the Catchment Area Park;
(g)discharge any missile, firework, cracker, firearm, air-gun or other weapon;
(h)place, deposit or throw any refuse, rubbish, litter, food, bottle, glass, can or other article or thing in any place other than a refuse bin or receptacle provided for the purpose;
(i)distribute any pamphlets, handbills or documents to other persons, or affix or post the same or any bill, placard, notice or advertisement to any wall, tree, fence or structure;
(j)remove, damage, displace, deface or make improper use of any seat, shelter, structure, notice, label, appliance, equipment, fitting or other property of the Board;
(k)use any musical instrument, apparatus or thing producing sound or noise in such manner as to cause annoyance, inconvenience or offence to other persons;
(l)obstruct any employee of the Board in the execution of his duty;
(m)take into, or drink in, any part of the Catchment Area Park any intoxicating liquor;
(n)ply any article or thing for hire;
(o)destroy, damage, remove or displace any stone or granite block which is part of the structure of the reservoir; or
(p)take water from any toilet facilities to wash any vehicle.
Activities requiring prior approval
7.  No person in the Central Water Catchment Area or in a Catchment Area Park shall, without the prior approval in writing of the authorised officer —
(a)enter or fish in any reservoir or stream;
(b)collect any bird’s egg or nest;
(c)remove or cut any plant, shrub or tree or any part of the same;
(d)burn any matter or thing;
(e)erect or assemble any tent or structure or set up a caravan for the purpose of camping;
(f)expose for sale or sell any merchandise, food or drink;
(g)use any part of the Central Water Catchment Area or Catchment Area Park as a location for the shooting of a film or the setting of a play;
(h)place, berth or operate any boat or marine craft;
(i)use any live bait for fishing;
(j)draw water from any reservoir or stream; or
(k)feed any marine animal with any kind of food.
Exemptions
8.  Notwithstanding regulations 6 and 7, the Chairman or the Chief Executive may, in his discretion, authorise in writing any member or employee of the Board or any person to perform or carry out any act prohibited by those regulations if he considers that —
(a)it would be in the interest of, or for the benefit of, the Central Water Catchment Area or a Catchment Area Park; or
(b)there exists any other good cause,
for such act to be performed or carried out by such member, employee or person.
Discretion to prohibit animals from entering Catchment Area Park
9.  Notwithstanding regulation 6(e) —
(a)an authorised officer may, in his discretion, order any person having in his charge any animal to take the animal out of any Catchment Area Park, and that person shall immediately comply with the order; and
(b)the Board or the authorised officer may, by notice in writing, prohibit any person from taking any animal or class of animals into any Catchment Area Park.
Prohibition of animals in Central Water Catchment Area
10.  No person shall allow any dog or any other animal to stray in the Central Water Catchment Area or lead, drive, tether or ride any animal in such water catchment area.
Camp or caravan in Central Water Catchment Area or Catchment Area Park
11.  Any person who is permitted to set up a camp or caravan under regulation 7(e) shall keep the camp or caravan site in a clean and tidy condition and shall remove the camp or caravan from the Central Water Catchment Area or a Catchment Area Park when directed to do so by the authorised officer.
Offenders may be ordered out of Central Water Catchment Area or Catchment Area Park
12.—(1)  Any person who contravenes regulation 4, 5, 6 or 7 may be ordered out of the Central Water Catchment Area or Catchment Area Park by any police officer or authorised officer and may be refused admission thereto by the police officer or authorised officer.
(2)  This regulation shall not be construed as preventing any person from being prosecuted for any contravention of regulation 4, 5, 6 or 7.
Offences and penalties
13.  Any person who contravenes regulation 4, 5, 6, 7, 10 or 11 or any order made or given under regulation 9 shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $3,000.
Seizure of animals, vehicles, etc.
14.—(1)  Any animal found in the Central Water Catchment Area or a Catchment Area Park in contravention of regulation 6(e) or any vehicle or boat or water pump or thing used or in respect of which there is reasonable cause to suspect that it has been used in the commission of any offence under regulation 5 or 7 may be seized and detained by the authorised officer.
(2)  Wherever any item is seized under paragraph (1), the authorised officer who carried out the seizure shall give notice in writing of the seizure to the owner of that item, if known, either by delivering the notice personally to him or by post at his place of abode, if known.
(3)  The notice shall not be required to be given where the seizure is made in the presence of the offender or owner or his agent.
(4)  Every seizure shall be reported to a Magistrate’s Court.
(5)  Where it is proved to the satisfaction of the Magistrate’s Court that the item seized was the subject-matter of or was used in the commission of the offence, the Court may order the item seized to be destroyed or disposed of in such manner as the Court may think fit notwithstanding that no person may have been convicted for that offence.
Exclusion
15.  These Regulations shall not apply to any person in the Central Water Catchment Area or in a Catchment Area Park occupied by the Singapore Zoological Gardens or the Night Safari.
