(Carriage of Persons in Goods Vehicles — Weddings, Funerals and Religious Processions)
(Exemption) Order 2011
In exercise of the powers conferred by section 142 of the Road Traffic Act, the Minister for Transport hereby makes the following Order:
Citation
1.  This Order may be cited as the Road Traffic (Carriage of Persons in Goods Vehicles — Weddings, Funerals and Religious Processions) (Exemption) Order 2011.
Definitions
2.  In this Order, “assembly”, “procession”, “public assembly” and “public procession” have the same meanings as in the Public Order Act 2009 (Act 15 of 2009).
Exemption for goods vehicles used in connection with weddings, funerals or religious processions
3.—(1)  Subject to sub-paragraph (2), the written laws set out in the Schedule shall not apply to the use on any road of any goods vehicle for the carriage of persons participating in —
(a)any public assembly or public procession that is held in connection with a wedding or a funeral; or
(b)any religious procession in respect of which a permit is granted under the Public Order Act 2009.
(2)  The exemption referred to in sub-paragraph (1) is subject to the following conditions:
(a)the goods vehicle shall be driven in a safe manner having regard to the safety of all passengers on the vehicle;
(b)the goods vehicle shall not be driven at a speed which exceeds 15 km/h when it is carrying any person who is not in a sitting position; and
(c)there shall be in force at all times when the goods vehicle is being used for the purpose referred to in sub-paragraph (1), a policy of insurance in relation to the vehicle insuring against any liability in respect of the death of, or bodily injury sustained by, any person caused by or arising out of the use of the vehicle.
