(Self-Drive Private Hire Cars — Exemption)
Order 2017
In exercise of the powers conferred by section 142 of the Road Traffic Act, the Minister for Transport makes the following Order:
Citation and commencement
1.  This Order is the Road Traffic (Self-Drive Private Hire Cars — Exemption) Order 2017 and comes into operation on 20 June 2017.
Definition
2.  In this Order, “self‑drive private hire car” means a motor car that —
(a)does not ply for hire on any road and is hired, or made available for hire, under a contract (express or implied), for use as a whole by a hirer, or any other person authorised by the hirer in the contract, to drive the car personally; and
(b)is licensed under Part V of the Act for the use described in paragraph (a).
Exemption from vocational licence
3.—(1)  Section 110(1)(a) of the Act does not apply to an individual who drives a self‑drive private hire car (called the driver) if —
(a)the driver is —
(i)the holder of the public service vehicle licence for the car or an individual who is authorised by the holder of such a licence to drive the car; or
(ii)the hirer of the car under a contract for use as a self‑drive private hire car or an individual authorised by the hirer in the contract to drive the car personally; and
(b)the car is used only to convey the driver, with or without any passengers, in a journey to a destination without reward to the driver for that journey.
(2)  Rule 6 of the Road Traffic (Public Service Vehicles) Rules (R 14) does not apply to the holder of a public service licence for a self‑drive private hire car when the car is driven by an individual mentioned in sub‑paragraph (1)(a)(i) or (ii) in the circumstances mentioned in sub‑paragraph (1)(b).
