Road Traffic
(Exemption of Heavy Vehicles)
Order 2015
In exercise of the powers conferred by section 142 of the Road Traffic Act, the Minister for Transport makes the following Order:
Citation and commencement
1.  This Order may be cited as the Road Traffic (Exemption of Heavy Vehicles) Order 2015 and comes into operation on 6 November 2015.
Definitions
2.  In this Order, unless the context otherwise requires —
“bus services contractor” means any person who has a contract with the Authority to provide 10 or more regular route services specified in the contract;
“community bus service” means a bus service —
(a)consisting of the carriage of passengers by a bus for or in connection with the activities of a religious, educational, health, welfare, philanthropic, sporting or charitable organisation; and
(b)provided for a fare, or for consideration which is limited to the costs or part of the costs incurred in making the journey;
“courtesy bus service” means a bus service which is —
(a)provided for the purpose of promoting the sale or supply of any product or service sold or supplied by a business organisation in the course of business in Singapore; and
(b)provided for a fare, or for consideration which is limited to the costs or part of the costs incurred in making the journey;
“heavy vehicle” has the same meaning as in the Parking Places Act (Cap. 214);
“regular route service” means a bus service that is conducted according to pre‑determined routes and timetables with 2 or more bus stopping points within Singapore, but does not include —
(a)a tourist bus service;
(b)a community bus service; or
(c)a courtesy bus service;
“tourist bus service” means a bus service where —
(a)tourism is a major and regular feature or focus of the service;
(b)the passenger profile including, in particular, whether users of the service, are mainly sightseers or pursuing mainly tourism activities;
(c)all passengers’ journeys stop at or divert to points of cultural, historic, scenic, scientific or sporting interest in Singapore; and
(d)the passengers are taken on to or back to hotels or other tourist accommodation or a tourism travel connection.
Exemption
3.—(1)  Section 10B of the Act and rule 28 of the Road Traffic (Motor Vehicles, Registration and Licensing) Rules (R 5) do not apply to —
(a)any heavy vehicle belonging to the Government;
(b)any heavy vehicle falling within a category of vehicles specified in section 14(a), (b), (c), (d), (e) or (f) of the Act;
(c)any omnibus which is registered in the name of —
(i)SBS Transit Ltd.;
(ii)Singapore‑Johore Express Pte. Ltd.; or
(iii)SMRT Buses Ltd.;
(d)any omnibus which is registered in the name of any bus services contractor, and which is or is to be used for any regular route service; or
(e)any heavy vehicle registered in the name of any statutory board.
(2)  Section 19(3)(f) of the Act does not apply to any omnibus referred to in sub‑paragraph (1)(c) or (d) or any heavy vehicle referred to in sub‑paragraph (1)(e).
Revocation
4.  The Road Traffic (Exemption of Heavy Vehicles) Order (O 9) is revoked.
