(Car Bodies Fairway Taxis) (Exemption)
Order 2012
In exercise of the powers conferred by section 142 of the Road Traffic Act, the Minister for Transport hereby makes the following Order:
Citation and commencement
1.  This Order may be cited as the Road Traffic (Car Bodies Fairway Taxis) (Exemption) Order 2012 and shall come into operation on 8th March 2012.
Exemption
2.  Subject to the conditions specified in paragraph 3, every taxi registered in the name of SMRT Taxis Pte. Ltd. and described in the Schedule shall be exempted from —
(a)section 27(1)(e) of the Act in so far as it applies to cancel the registration of any such taxi where the age of the taxi exceeds 8 years;
(b)rule 4(2)(c)(ii) of the Road Traffic (Public Service Vehicles) Rules (R 14) in so far as it does not permit the renewal of a licence granted under Part V of the Act in respect of a taxi more than 8 years old;
(c)rule 16(1)(a)(iii) of the Road Traffic (Motor Vehicles, Quota System) Rules (R 31) in so far as it limits the term of the certificate of entitlement for the taxi to 8 years; and
(d)rule 8 of the Road Traffic (Motor Vehicles, Registration and Licensing) Rules (R 5) in so far as it does not allow an application for and the grant of the rebate under that rule in respect of the taxi.
Conditions of exemption
3.  The exemptions under paragraph 2 are subject to the following conditions:
(a)each taxi described in the Schedule must also be used in the service of conveying disabled persons in wheelchairs, of which service shall be approved by the Registrar;
(b)where the certificate of entitlement for a taxi described in the Schedule had been issued under rule 11 of the Road Traffic (Motor Vehicles, Quota System) Rules (R 31), an additional quota premium shall be payable to the Registrar prior to the expiry of the term of the certificate of entitlement or such further period of time as the Registrar may extend under rule 24(3A) of those Rules;
(c)the additional quota premium payable under sub‑paragraph (b) shall be the difference between the following sums:
(i)90% of the amount calculated in accordance with rule 14(1)(a) of the Road Traffic (Motor Vehicles, Quota System) Rules;
(ii)the quota premium paid under rule 14(1)(d) of those Rules when the taxi was registered;
(d)where the certificate of entitlement for a taxi described in the Schedule had been restored under rule 24(6) of the Road Traffic (Motor Vehicles, Quota System) Rules, an additional levy shall be payable to the Registrar prior to the expiry of the term of the certificate of entitlement or such further period of time as the Registrar may extend under rule 24B(6) of those Rules;
(e)the additional levy payable under sub‑paragraph (d) shall be the difference between the following sums:
(i)90% of the average of the quota premiums payable for certificates of entitlement in relation to the category of vehicle specified in rule 3(1)(a) of the Road Traffic (Motor Vehicles, Quota System) Rules issued during the 3 months immediately preceding the restoration of the certificate of entitlement;
(ii)the amount paid under paragraph (1)(ba) of the First Schedule to the Road Traffic (Motor Vehicles, Quota System) Rules when the taxi was registered;
(f)each taxi described in the Schedule shall be equipped with a wheelchair ramp approved by the Registrar for the purpose of a service of conveying disabled persons in wheelchairs;
(g)where the registration of any taxi described in the Schedule is cancelled, and the taxi is more than 8 years old but equal to or less than 9 years old when the registration is cancelled, any applicable rebate which the Registrar may grant under rule 8 of the Road Traffic (Motor Vehicles, Registration and Licensing) Rules (R 5) shall be computed in accordance with paragraph (7)(c) of that rule; and
(h)SMRT Taxis Pte. Ltd. shall produce proof to the satisfaction of the Registrar that any taxi described in the Schedule has been permanently removed from all roads in Singapore, or has been destroyed or permanently removed from Singapore, within one month (or such further period as the Registrar may allow in any particular case) after the occurrence of either of the following events:
(i)the expiry of the certificate of entitlement of the taxi;
(ii)the cessation of the conveyance service in respect of any taxi referred to in sub‑paragraph (a).
