Singapore Sports Council (Constituency Sports Clubs) Regulations

Citation
1.  These Regulations may be cited as the Singapore Sports Council (Constituency Sports Clubs) Regulations.
Application
2.  These Regulations shall apply to constituency sports clubs established by the Council.
Definitions
3.  In these Regulations —
“adviser” means the adviser of the club appointed by the Council;
“assistant secretary” means the assistant secretary of the club;
“assistant treasurer” means the assistant treasurer of the club;
“by-laws” means the by-laws made by the committee under regulation 27;
“chairman” means the chairman of the club;
“club” means the constituency sports club in question;
“committee” means the management committee of the club;
“Council” means the Singapore Sports Council;
“Director” means the Chief Executive Director of the Singapore Sports Council;
“honorary patron” means the honorary patron of the club;
“members” means the enrolled members of the club;
“secretary” means the secretary of the club;
“treasurer” means the treasurer of the club;
“vice-chairman” means the vice-chairman of the club.
Name
4.  The name of the club shall be “ Constituency Sports Club”, the constituency to be specified being the constituency in which the club premises are located.
Objects
5.  The objects for which the club is established are —
(a)to promote sports for the people living in the constituency in which the club premises are located;
(b)to select and train sportsmen from the constituency for participation in all inter-constituency sports;
(c)to supply to the Council information of the needs of the residents of the constituency; and
(d)to keep the residents of the constituency informed of Government action and policy on all matters pertaining to sports.
Constitution
6.  The club is a proprietary club, the proprietors of which are the Council.
Membership
7.—(1)  Membership of the club shall be open to all residents of Singapore.
(2)  The management committee with the approval of the Council may at its discretion require members to pay an entrance fee and such subscription as may be decided upon from time to time by the management committee.
(3)  Every application for membership shall be made on the form provided by the committee.
(4)  A person shall, upon acceptance of his application by the committee, become a member of the club and shall be issued with a membership card.
Members bound by Regulations and by-laws
8.  All members of the club shall be deemed to have agreed to be bound by these Regulations and the by-laws of the club for the time being in force.
Subscriptions
9.  Every member of the club shall not by reason of his membership be under any financial liability except for the payment of his subscription.
Advisers
10.  The adviser shall advise the club on all matters pertaining to sports in that constituency.
Honorary patrons
11.  The club shall have one or more honorary patrons who shall be appointed by the Council on the recommendation of the adviser.
Management of club
12.—(1)  The management of the club shall be entrusted to a committee consisting of —
(a)the chairman;
(b)not more than 3 vice-chairmen;
(c)the secretary;
(d)the assistant secretary;
(e)the treasurer;
(f)the assistant treasurer; and
(g)9 other members,
all of whom shall be appointed by the Council on the recommendation of the adviser.
(2)  Members of the committee shall normally be appointed from amongst persons who are —
(a)residents of or have their place of business in the constituency; and
(b)citizens or permanent residents of Singapore.
(3)  Notwithstanding paragraphs (1) and (2), the Council may, in special circumstances and on the recommendation of the adviser, appoint as members of the committee persons who are not residents of or do not have their place of business in the constituency.
(4)  Members of the committee shall not be disqualified from continuing to serve in the committee if they cease to be residents or cease to have their place of business within the constituency.
Members of committee
13.—(1)  A member of the committee shall hold office for a period of two years and may resign from his office by giving one month’s notice.
(2)  The Council may at any time terminate the appointment of a member of the committee without assigning any reason.
(3)  Any member of the committee who absents himself from 3 consecutive meetings without the leave of the committee shall be deemed to have vacated his office.
(4)  Where the office of any member of the committee is vacated or terminated the Council may, on the recommendation of the adviser, appoint a person to fill the vacancy for the remaining term of office of the committee member whose appointment is terminated or who has vacated his office.
Dissolution of committee
14.  The Council may at any time dissolve the committee and upon dissolution of the committee, the management of the club shall be vested in the Council.
Powers of committee
15.  The committee may exercise all such powers as are conferred upon the committee by these Regulations and the by-laws and such other powers of management that may be conferred by the Council from time to time for the conduct of the affairs of the club.
Sub-committees
16.—(1)  The committee may from time to time appoint various sub-committees to assist in organising the activities of the club.
(2)  The committee shall have the powers to restrict the number of members of sub-committees.
Powers of Director
17.—(1)  The committee shall perform such duties as may be required by the Director from time to time.
(2)  The committee shall furnish the Director with such information as he may require from time to time.
Fees
18.—(1)  The committee may collect fees for participation in organised activities in accordance with rates approved by the Council.
(2)  The committee shall have authority to make payments out of the funds of the club for any of the following purposes:
(a)for the general improvement of its facilities;
(b)for the furtherance of activities within the established programme of the club; and
(c)for the purchase of furniture and equipment.
(3)  Where a donation is accompanied by an express wish by the donor that it is to be used for a particular purpose, the committee shall use the donation for the expressed purpose only.
Cheques
19.  Cheques drawn on the club’s bank account shall be signed by the treasurer or assistant treasurer and either the chairman or the secretary.
Quorum
20.—(1)  A quorum for a meeting of the committee shall be 5 members.
(2)  The chairman of the committee, or in his absence a member of the committee to be elected by the committee members present at the meeting, shall preside at meetings of the committee.
(3)  Decisions at meetings of the committee shall be adopted by a simple majority of the votes of the committee members present and voting except in the case of an equality of votes the chairman of the meeting shall have a casting vote.
(4)  The committee shall not be precluded from holding any meeting or acting in any matter merely by reason of any vacancy in its membership.
(5)  The minutes of each meeting shall be confirmed at the first subsequent meeting and a copy of the confirmed minutes shall be sent to the Director within 14 days of the confirmation.
Annual and supplementary estimates
21.—(1)  The committee may approve the annual estimates of expenditure of the club and thereafter submit a copy of the estimates to the Director.
(2)  The committee may approve supplementary estimates of expenditure where necessary and thereafter submit a copy of the estimates to the Director.
(3)  Paragraphs (1) and (2) shall not affect the power conferred upon the Council by paragraph (4).
(4)  The Council may from time to time give instructions on the disbursement of funds under such estimates in keeping with the objects of the club.
Duties of treasurer
22.—(1)  Every item of cash, donations or goods received by the club shall be duly recorded by the treasurer or assistant treasurer who shall acknowledge each item with a receipt in a form approved by the Director.
(2)  The treasurer shall pay into the club’s bank account all moneys received by the club and shall be responsible for the safe custody of the moneys.
(3)  The treasurer may retain in cash a sum not exceeding $100 for petty cash expenses.
(4)  Every item of expenditure incurred shall be duly supported by bills, receipts or other documentary proof and a payment voucher in a form approved by the Director.
(5)  The treasurer shall, at every monthly meeting of the committee, present a statement of receipts and payments of the club, if any, for the month immediately preceding the meeting.
(6)  Except for organised activities where the collection of fees have been approved, all fees proposed to be levied by the club on participants in organised activities shall not be levied without the prior approval of the Director.
Annual accounts and report
23.—(1)  The committee shall, at the end of each financial year, submit to the Director a statement of accounts within one month of the end of the financial year or such later date as may be approved by the Director. The statement of accounts shall be audited by the Council.
(2)  The committee shall also submit an annual report of the activities of the club for each financial year.
(3)  The financial year of the club shall end on 31st March in each year.
Discipline
24.—(1)  The committee may expel from the club any member whose conduct is such as shall in the opinion of the committee be injurious to the dignity of the club or contrary to the interest of the members.
(2)  Before a member is expelled his conduct shall be inquired into by the committee and he shall be given full opportunity to defend himself and to justify or explain his conduct.
(3)  If the committee is of the opinion that the member has been guilty of such conduct as aforesaid and that the member has failed to justify or explain it satisfactorily, the committee shall call upon the member to resign, and if he does not resign shall expel him.
(4)  A member expelled by the club shall forfeit all the privileges of membership and all rights against the Council.
Suspension
25.—(1)  The committee may suspend for a period not exceeding 6 months the membership of any member whose conduct is such as shall in the opinion of the committee be injurious to the dignity of the club or contrary to the interests of the members.
(2)  Before a member is suspended, the committee may at its discretion inquire into his conduct and give him an opportunity to defend himself and to justify or explain his conduct.
(3)  A suspended member shall cease to have the privileges of membership and all rights against the Council during the period of suspension.
Appeal
26.  A member who has been expelled or suspended by the committee may appeal to the Council against the expulsion or suspension and the decision of the Council shall be final.
By-laws
27.—(1)  The committee shall have the power to make, vary or revoke by-laws for the regulation of the internal affairs of the club and the conduct of members.
(2)  All by-laws shall, until revoked by the committee, be binding on all members.
Liability for death or personal injuries
28.  The Council shall not be liable for the death of or personal injuries to any member arising in any way out of his membership of the club or through his use or enjoyment of the club, its amenities, privileges or facilities or otherwise howsoever arising.
Liability for personal property
29.  The Council shall not be liable for the loss of or damage to any articles or properties whatsoever brought to the club premises by any member.
Notices
30.—(1)  All notices required by these Regulations or the by-laws to be given to members may be given by prepaid letter addressed to a member at his last known address which was furnished to the secretary and shall be deemed to have been given on the day when the letter would have arrived in the ordinary course of post.
(2)  Members shall notify the secretary of any change of address.
Prohibitions
31.—(1)  Gambling of any kind shall be prohibited in the club premises unless it is for the expressed purpose of raising funds for the purposes of the club and the necessary permit or licence has been obtained from the competent authorities.
(2)  The club premises shall not be used for political purposes.
(3)  The members shall not use the club premises for any trade union activity as defined in the Trade Unions Act [Cap. 333].
(4)  No paper, notice or placard, written or printed, shall be put on the notice board or premises of the club without the approval of the committee.
Disputes to be settled by Director
32.  Any dispute or difference which may arise as to the meaning or interpretation of these Regulations or the by-laws or as to the powers of the officers of the committee or the validity of any member or any proceeding of the committee shall be determined by the Director whose decision shall be final and binding upon all the members.
