Citation |
1. These Regulations may be cited as the Street Works (Private Street Works) Regulations. |
Definitions |
2. In these Regulations, unless the context otherwise requires —

Application |
3. These Regulations shall apply to the construction of any new private street commencing on or after 1st September 1995. |
Street plan |
Documents to be submitted |
5.—(1) The following documents shall be submitted to the Authority before the street plan may be approved:

Approved street plan not to be amended without approval |
6. No person shall amend any street plan approved by the Authority without the prior approval of the Authority. |
Scales of plan |
7. Where the following plans are required to be submitted, they shall be drawn to the following scales:

Site plan |
8.—(1) The site plan shall show —

Traffic plan |
9. The traffic plan shall show the traffic scheme proposed for the new street and adjoining existing streets. |
Topographical survey plan |
10. The topographical survey plan shall show —

Longitudinal section plan |
11.—(1) The longitudinal section plans shall consist of —

Cross-sectional plan |
12.—(1) The cross-sectional plans of streets shall show —
|
Construction of private street |
13. The construction of a private street and the materials used therein —
|
Design and construction of pavement, etc. |
14.—(1) The pavement structure of the carriageway, footways, kerbs, scupper drains and roadside drains shall be of such design and construction as the Authority may direct in writing from time to time.

Bridges and culverts |
15.—(1) The sizes of the bridges and culverts shall be such as to permit the full discharge of the drains over which such bridges and culverts pass.

Construction to be under charge of qualified professional engineer |
16.—(1) The construction of any street shall be supervised by a qualified professional engineer.

Accredited checkers for design of structural elements |
17.—(1) The design of all key structural elements of any proposed new street shall be checked and certified by an accredited checker appointed by the person intending to construct the new street.

Duties of accredited checkers |
18.—(1) It shall be the duty of an accredited checker to —

Certification of adequacy of key structural elements |
19. An accredited checker shall, without delay after performing his duty in relation to any plans for the construction of a new street, prepare and submit to the person for whom the street works are to be carried out —

Proper lighting and traffic signs |
19A. It shall be the duty of the person carrying out any works on a private street and the person for whom the works are being carried out to ensure that —

Inspection and test by Authority |
20.—(1) For the purpose of satisfying itself that a private street may be declared to be a public street under section 26 of the Act, the Authority may carry out such inspection and tests as it considers necessary.

Transitional provisions |
21. Any approval, requisition, order, direction, notice or submission issued, made or given under the revoked Local Government Integration (Street Works) Regulations shall be treated as an approval, requisition, order, direction, notice or submission issued, made or given under these Regulations and have the same force and effect as an approval, requisition, order, direction, notice or submission issued, made or given under these Regulations.
