Town Council of City Centre (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges) By-laws

Citation
1.  These By-laws may be cited as the Town Council of City Centre (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges) By-laws.
Calculation of penalty and administrative fee for conservancy and service charges in arrears
2.  A tenant or owner shall be liable to pay the Town Council of City Centre —
(a)a penalty at the appropriate rate set out in the Schedule for every month in which any conservancy and service charges payable by him to the Town Council are in arrears and the penalty shall become due and payable on the day following the expiry of that month; and
(b)an administrative fee of $2 —
(i)if any conservancy and service charges are not paid within 17 days from the expiry of the one month after the date the charges become due and payable; or
(ii)if any penalty imposed under sub-paragraph (a) is not paid within 17 days after the penalty becomes due and payable.
Application of payment
3.  The Town Council may, in its discretion, apply any moneys paid by the tenant or owner firstly towards the payment of the amount of any penalty and administrative fee payable under these By-laws and subsequently apply any balance thereof towards payment of any amount of outstanding conservancy and service charges.
Remission
4.  The Town Council may, in its discretion, remit wholly or in part any penalty and administrative fee payable under these By-laws.
