Citation
1.  These By-laws may be cited as the Town Council of Holland (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges) By-laws.
Calculation of penalties for conservancy and service charges in arrears
2.  Where any conservancy and service charges payable by any tenant or owner to the Town Council of Holland are in arrears, the tenant or owner shall be liable to pay to the Town Council a penalty at the rate of 1% of the arrears per month rounded up to the nearest 50 cents subject to a minimum of $1 and such penalty shall become due and payable on the day following the expiry of that month.
Administrative fee
2A.—(1)  Where any conservancy and service charge due to the Town Council of Holland remains unpaid for a period of 5 months from the date on which it was due, the tenant or owner shall, in addition to any administrative fee which may be imposed under by-law 2, be liable to pay to the Town Council an administrative fee of $50.
(2)  The tenant or owner shall not be liable to pay the administrative fee referred to in paragraph (1) more than once in respect of the same period of 5 months or part thereof.

Levy of administrative fee
3.  The tenant or owner shall, in addition, be liable to pay to the Town Council of Holland an administrative fee of $2 for every month in which any conservancy and service charge or any penalty imposed under paragraph 2 is due and unpaid.
Application of payment
4.  The Town Council may, in its discretion, apply any money paid by the tenant or owner firstly towards the payment of the amount of any penalty and administrative fee payable under these By-laws and subsequently apply any balance thereof towards payment of any amount of outstanding conservancy and service charge.
Remission
5.  The Town Council may, in its discretion, remit wholly or in part any penalty or administrative fee payable under these By-laws.
