Town Council of Aljunied (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges and Licence Fees) By-laws 2006

In exercise of the powers conferred by section 24 (2)(a) and (c) of the Town Councils Act, the Town Council for the Town of Aljunied hereby makes the following By-laws:

Citation and commencement

1. These By-laws may be cited as the Town Council of Aljunied (Penalties and Administrative Fee for Late Payment of Conservancy and Service Charges and Licence Fees) By-laws 2006 and shall come into operation on 1st January 2007.

Calculation of penalties for conservancy and service charges and licence fees in arrears

2. Where any conservancy and service charge or licence fee payable by any tenant, owner or licensee to the Town Council of Aljunied is in arrears, the tenant, owner or licensee shall be liable to pay to the Town Council for every month in which the charge or fee is in arrears a penalty at the appropriate rate set out in the Schedule.

Administrative fee for conservancy and service charges, etc., in arrears

3.—(1) Where any conservancy and service charge, licence fee, penalty or any part thereof remains unpaid for a period exceeding 5 months from the date on which it was due to be paid, the tenant, owner or licensee concerned shall, in addition to any penalty which may be imposed under by-law 2, be liable to pay to the Town Council an administrative fee of $60.

(2) The tenant, owner or licensee shall not be liable to pay the administrative fee referred to in paragraph (1) more than once in respect of the same period of 5 months or part thereof.

Recovery of money under licence agreement

4. Nothing in these By-laws shall prejudice any right of action or other remedy of the Town Council for the recovery of any moneys due to the Town Council, under any licence agreement entered into between the Town Council and any licensee.

Application of payment

5. The Town Council may, in its discretion, apply any moneys paid by the tenant, owner or licensee under these By-laws —

(a)	firstly towards the payment of the amount of any administrative fee or penalty payable under these By-laws; and
(b)	thereafter apply any balance of such moneys towards payment of the amount of conservancy and service charge or licence fee or any part thereof which remains in arrears.

Waiver or refund

6. The Town Council may, in its discretion, waive or refund wholly or in part any administrative fee or penalty payable under these By-laws.

Revocation

7. The following By-laws are revoked:

(a)	the Town Council of Aljunied (Penalties for Late Payment of Conservancy and Service Charges and Licence Fees) By-laws 2002 (G.N. No. S 107/2002); and
(b)	the Town Council of Aljunied (Administrative Fee for Late Payment of Conservancy and Service Charges and Licence Fees) By-laws (By 63).
