Weights and Measures Act
(Chapter 349)
Weights and Measures (Defences under Section 19) Regulations 2005
In exercise of the powers conferred by sections 2, 19 and 37 of the Weights and Measures Act, the Minister for Trade and Industry hereby makes the following Regulations:
Citation and commencement
1.  These Regulations may be cited as the Weights and Measures (Defences under Section 19) Regulations 2005 and shall come into operation on 1st January 2006.
Inadequate packages and non-standard packages
2.  The amount of error prescribed for the purposes of the definitions of “inadequate package” and “non-standard package” are as specified in the First Schedule.
Conditions for section 19(5) of Act
3.—(1)  For the purpose of section 19(5)(a) of the Act, the condition which the package is required to meet is that the package must have been filled by an automatic filling machine.
(2)  For the purpose of section 19(5)(b) of the Act, the conditions which the lot of packages is required to meet are as follows:
(a)the number of non-standard packages in a sample taken from the lot of packages is equal to or less than the number of non-standard packages allowed for that sample; and
(b)there are no inadequate packages in the sample.
Taking of samples and non-standard packages allowed therein
4.  For the purposes of regulation 3(2) and section 19(6) of the Act, the Second Schedule shall apply in determining the size of a sample to be taken from a lot of packages and the number of non-standard packages allowed for the sample.
