Citation
1.  This Order may be cited as the Electricity (Electricity Generation and Retail Licence) (Exemption) Order.
Exemption from section 6(1)(a) of Act
2.  Section 6(1)(a) of the Act shall not apply to a company specified in the first column of the First Schedule in respect of a generating station which is located on the premises specified in the second column of that Schedule, subject to the following conditions:
(a)any generating unit in the generating station shall be of the description specified in the third column of that Schedule;
(b)the company shall not inject electricity generated from the generating unit into a transmission system;
(c)the company shall not register the generating unit under the market rules for the purpose of trading in any wholesale electricity market;
(d)the company shall comply with any code of practice issued or approved by the Authority under section 16 of the Act and any direction given by the Authority under section 17 of the Act; and
(e)any other condition specified in the fourth column of that Schedule.
Exemption from section 6(1)(c) of Act
3.  Section 6(1)(c) of the Act shall not apply to a company specified in the first column of the Second Schedule, subject to the following conditions:
(a)the company shall not register itself as a market participant of the retail electricity licensee class under the market rules;
(b)the company shall only retail electricity to a person specified in the second column of that Schedule for consumption on the premises of the person which is located within the premises of the company specified in the third column of that Schedule; and
(c)the company shall comply with any code of practice issued or approved by the Authority under section 16 of the Act and any direction given by the Authority under section 17 of the Act.
