Short title |
1. This Act is the Ngee Ann Polytechnic Act 1967. |
Interpretation |
2. In this Act, unless the context otherwise requires —

Incorporation of Ngee Ann Polytechnic |
3. There is constituted in accordance with the provisions of this Act a Polytechnic with the name and style of the Ngee Ann Polytechnic, which is a body corporate with perpetual succession and must have a common seal, with full power by and in that name to sue and be sued and to perform any other acts that bodies corporate may by law perform, and with other powers conferred by this Act. |
Objects and functions of Polytechnic |
4. The objects and functions of the Polytechnic are —

Council and Senate |
5. The Polytechnic has a Council and a Senate, whose composition, functions and powers are as set out in this Act. |
Council to be supreme governing body |
6. The Council is, subject to the provisions of this Act, the supreme governing and executive body of the Polytechnic and must administer the property of the Polytechnic in accordance with its objects and functions as set out in section 4. |

Vacation of office of member of Council |
8.—(1) The office of a member of the Council is vacated if the member —

9.—(1) If the office of a member of the Council, other than that of the Principal, is vacant, the Minister may appoint any person to fill the vacancy and to hold the office for the remainder of the term of the person’s predecessor.

Functions of Council |
10.—(1) It is the duty of the Council to exercise its powers in the manner best calculated to promote the objects and functions of the Polytechnic.

11. For the purpose of giving effect to the provisions of this Act, the Council may, where it considers it necessary or expedient —

Meetings of Council |
12.—(1) The Chairperson must summon meetings of the Council as often as may be required.

Appointment and duties of Registrar |
13.—(1) There must be a Registrar of the Polytechnic who is to be appointed by the Council upon the terms and conditions determined by the Council.

Use of common seal |
14.—(1) The common seal of the Polytechnic must be in the custody of the Principal and must not be affixed to any instrument, other than a diploma or academic certificate, except in the presence of the Chairperson or a member of the Council and the Principal, who must sign their names to the instrument in token of their presence before the common seal is affixed and the signing is sufficient evidence that the common seal of the Polytechnic has been duly and properly affixed and that the seal is the lawful seal of the Polytechnic.

15.—(1) The Senate, subject to the provisions of this Act and of any rules made under this Act, has the control of —

Committees and boards |
17.—(1) The Council and the Senate may appoint such committees or boards as the Council and the Senate respectively may think fit.

Appointment and duties of Principal |
19.—(1) The Council must appoint the Principal of the Polytechnic upon the terms and conditions determined by the Council.

Other officers and employees, etc. |
19A. The Council may, subject to the Public Sector (Governance) Act 2018, appoint and employ, on the terms and conditions determined by the Board, such other officers, employees, consultants and agents as may be necessary for the effective performance of its functions. [5/2018] |
Income and property of Polytechnic |
20.—(1) The income and property of the Polytechnic include —

Issue of shares, etc. |
20A. As a consequence of the vesting of any property, rights or liabilities of the Government in the Polytechnic under this Act, or of any capital injection or other investment by the Government in the Polytechnic in accordance with any written law, the Polytechnic must issue such shares or other securities to the Minister for Finance as that Minister may direct. Ngee Ann Polytechnic Students’ Union |
22.—(1) There is to be a students’ association called the Ngee Ann Polytechnic Students’ Union which is constituted by rules made under section 24(1) and consists of the constituent bodies prescribed by those rules.

Application of Societies Act 1966 to Students’ Union |
23.—(1) Despite anything to the contrary in the Societies Act 1966, the provisions of that Act apply to the Ngee Ann Polytechnic Students’ Union and its constituent bodies constituted by rules made under section 24(1).

Rules |
24.—(1) The Council may, with the approval of the Minister, make any rules that seem to it to be necessary or expedient for the purpose of carrying out the provisions of this Act.

Construction of contracts, gifts, etc. |
25. On and after 16 April 1982, any reference to the Ngee Ann Technical College contained in any contract, agreement, bequest, will, trust or other instrument has effect as if it were a reference to the Ngee Ann Polytechnic. |
