An Act to provide for the prohibition or control of the export of certain planting material.

Short title
1.  This Act may be cited as the Export of Plants (Control) Act.
Interpretation
2.  In this Act, “plant” means any tree, shrub or plant used in agriculture.
Power to prohibit export
3.  The Minister may by notice in the Gazette prohibit the exportation from Singapore, or any part thereof, either absolutely or subject to such conditions as may be specified in the notice, or to any named country, territory or place, of any plant or part thereof which is capable of use for the reproduction of that plant.
Penalty
4.—(1)  Any person who contravenes the provisions of this Act or who fails to comply with or breaks any condition imposed thereunder shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $2,000.
(2)  A Magistrate’s Court shall have jurisdiction to hear and determine all prosecutions under this Act and, notwithstanding anything to the contrary in the Criminal Procedure Code [Cap. 68], may impose the full penalty or punishment provided by this Act.
Seizure and forfeiture
5.—(1)  Any person generally or specially authorised in writing in that behalf by the agricultural officer may seize any plant together with any package, vessel or vehicle which may reasonably be believed to be the subject matter of an offence under this Act or to be or about to be used in the commission of an offence.
(2)  When any person is convicted of an offence under the provisions of this Act any plant with respect to which the offence was committed may be forfeited by order of the court.
(3)  Any order of forfeiture of any plant under this section may include any package, vessel or vehicle in which the plant is found.
(4)  The Minister may order any vessel or vehicle seized under this section whether forfeited or not to be delivered to the proprietor thereof upon such terms and conditions as he may consider fit.
Rules
6.  The Minister may make rules for the carrying out of the purposes of this Act.
